We traveled to Orlando on June 28, 2005 and rented a car from Thrift Car Rental office. We were lured to buy a discount ticket for Sea World at the office as the ticket sales person told us that we qualified for a discount because we rented the car from their office. The agent then told us to go to Westgate resort to get the ticket, but she did NOT mention that there will be a presentation at all. When we arrived at Westgate resort to get the ticket, we were given a presentation to purchase a time share resort. After a long presentation, we were convinced to buy one with a total price of $20,000 for the right to use a two bedroom condo, one week per year. We paid a deposit of $1,500 at the time.
On the second day (June 29, 2005), we felt that we rushed into making the purchase, so we went to the Westgate resort to meet the manager, in order to cancel the purchase. We were greeted by the closing agent at the office. She told us that the company would not accept our cancellation and offered a lower price of $12,000 for a one week use, every two years time share plan. When asking about that the 10 cooling days for cancellation protected by the law, she said that the law protects the consumer as well as the company and she said that a penalty applied to the cancellation. She said that there is always money involved with the cancellation and she would not like us to lose money. She kept telling us that she is working as a neutral party for the closing and that she is not working for the company. When asking about how much money we will lose for the cancellation, she said that it could be anywhere from $500 to $5,000.
We were so worried that we could not take back our $1,500 deposit, and so we accepted the new offer.
they actively dissuaded us from turning the cancellation papers in by misrepresenting Florida law to us. They actively placed UNDUE influence over us, by telling us that a penalty would be applied to the cancellation and telling us they did not want us to lose money.
We still want to cancel the purchase now, those actions by the Westgate resort were sufficiently egregious to override the cancellation period.

Westgate Timeshare Sales Agreement

A Westgate timeshare sales agreement is the contract that you get at the moment you purchase a fractional ownership. Most timeshare companies make them long and difficult to understand, so the buyer doesn’t know well what he is getting into, and the terms and conditions are especially made to benefit the resort, but not the owner. The timeshare sales agreement gives you the right to use the resort, during a certain number of years, for a specific number of weeks. That means that the developer still owns the resort, so your interest would not be considered as real estate. Also, it is very likely that most of the verbal promises told during the presentation are not in the contract, and many of the agreements have no cancellation policy.

We just got back from Orlando, and we done the whole 90 min tour which turned into 6hrs with us.....we bought a vacation package from them and we got home we decided we made a big mistake so we sent a letter along with the memebership kit we got saying we dont want it and thank god we only put a $60 deposit down on it. We may or may not get the 60 back but we requested it.....on the letter we got it notorized and everything and sent it certified mail. Plus we cancelled the credit card they would be charging every month. I feel your pain it is so crazy how the state of FL will let these ppl do this to hardworking ppl that come to there state every year to spend lots of money on vacation. I WILL NEVER DO ANOTHER TOUR!!!!!! SCREW WESTGATE!!!! Im just waiting for them to say we cant cancel and give us a penelty and we will be getting a lawyer if so....You have 10 days by the st of FL to cancel and it says nothing about a penelty.....i just think its so funny when u sign up for the tour it says NO OBLIGATION TO BUY....yea right they hound u and bring u down till your so tired that u wanna get out of there so u say yes...there not dummies!!!!!!

I am so sorry for your experience. You were smart to try cancel while in Florida and you should have been able to do so. This is an all-time low, even for Westgate. To stoop to this illegal tactic and outright lie is appalling. I guess there is no limit to how low Westgate will stoop to rip off people. From what I've learned about this company in the last year, I cannot say I am totally surprised.
We who have been ripped off must ban together. This sick giant must be brought down. Westgate conducts business as if it is above the law. The State of Florida needs to show Westgate that it is not.
