I purchased an investment property on the Jersey Shore in 2007. The property was supposed to be renovated within 6 months so that it could either be used as a summer home, rented for income or sold at a profit.  Unfortunately, the developer sold me a bill of goods and never completed the renovation. To boot, the municipality would not issue a C of O so no one could live in the property for over a year. 


As this progressed, I started contacting, first Countrywide (who owned the mortgage) and then Bank of America (who bought out Countrywide) in November 2008 asking for some assistance as I had carried the mortgage for over a year without any income and was about to lose my job. I was told they couldn't do anything. I ceased paying the mortgage in December 2008.

In January and again in March I had two buyers lined up to do a short sale. Both times BofA refused the offers as being too low. 

I made numerous calls during the months of January-April 2009 and finally was given instructions for what I needed to do for a deed in Lieu of foreclosure. I promptly listed the property on April 8 for the 3 months required time period.  I also sent in all the requested paperwork.  After the 3 months was completed, I contacted BofA on July 8, 2009 to finalize the deed in Lieu. I called them every other week through to September at which point they told me I had to re-list the property for 30 days because it was off the market for too long.  I re-listed it and called them back in October. In November they refused the deed in lieu because of paperwork missing which they had but lost. I resent the paperwork and they denied the request because the house was listed too high. I re-listed it at the lower price and they refused again because there was still paperwork missing (which again they misplaced).  I resent the paperwork again and was refused again because since the house was under renovation and had no toilet installed it was deemed unmarketable. They told me their investor would not take the property if was not re-sellable. I asked them to open the case back up and ask the investor. They refused me again. 

They told me I could list the property for $85,000 (which was what the original short sale offer was) and try to sell it or install the missing fixtures. I told BofA I would install the toilet and call them back. When I went to the property to install the toilet, I found that BofA had sent someone to secure the premises and change the locks.  I called them before Christmas to see what they had locked me out and they told me it was because I had abandoned it. I had not, and told them that every time I had spoken to them over the past year.  I requested the keys (3 times) so that I could go in a do the repairs but to date have yet to receive them. So, the real estate agent can't get in to show it, I can't get in to fix it and BofA will not do anything other than continue with the foreclosure proceedings. 

I have contacted the corporate headquarters to file a formal complaint and am awaiting a call back. If I do not get satisfaction, my next step is suing them.

October 2008 is the last I made payments.

Two prospectous short sales - lost because it took too long.

Many open houses, many for sale by owner, many many prospectous buyers but they all walked because it took to long.

Now going into the 3rd year they still say it is in modification stage.

Now I'm looking into deed in lieu of. The stress of BOFA is tremendous and my health is not worth a house!!!!
