CPS Use harassment and scare tactic towards little children, coworkers and family members

Consumer Portfolio Services has harassed me, my out-of-state family members, my coworkers and worst of all my children. I am a single mother who fell behind one payment, 30 days late, due to financial hardship. As if that wasn't bad enough I now had a new problem in the form of an employee of CPS name Crystal.

This woman telephoned my job repeatedly even after I asked on numerous occasions that CPS only telephone me at home. When my office relocated to a different location and I was given a new office number, CPS somehow found me and the phone calls during my work hours continued. My only guess is that CPS solicited my work number from our main office directory. CPS Crystal also telephoned my sister's home and harassed her family by telling my sister, her husband and all three of her children that CPS was in the process of reprocessing my vehicle. This was also done in an unprofessional, argumentative and abrasive manner, even when speaking to the children.

The worst offense committed by CPS Crystal was the harassment that my children have been enduring while I am at work. I have received numerous telephone calls from my 9, 13 and 18 year old daughters and son who were terrified because in their words the lady from CPS said that they are going to send some men here to take your car Mommy.

On Monday, July 21, 2008, I heard the phone ring as I was walking in my home from work. My youngest daughter who was on another level of the house had answered the phone and did not know that I was now home. I picked up the downstairs receiver in time to hear this woman yelling at my baby where is Evelyn ? I told my daughter that I was now home, and I asked her to hang up. I then asked this woman to identify herself she replied in a loud and abrasive tone this is Crys I again asked, ok Crys and what is this in concern to? Again, she replied in an abrasive tone Crys from CPS this was followed by what can only be classified as the most inappropriate, unprofessional, rude, cruel and down right utterly disgraceful rash of personal insults. At no time did Crys attend to any business matters concerning my vehicle, it was never mentioned at all. Also note that, I have made several payments through their website which I believe have not been accounted for.

What CPS is has been allowed to put consumers such as myself through is against the law. At no time is it alright for any company to harass consumers regardless of whatever financial difficulties that consumer is undergoing. Prior to my financial hardship I had always paid my CPS bills on time and falling behind on payments does not give them the right to harass, intimidate and scare my children. Nor does it give them the right to embarrass me at work and it definitely does not give them the right to continuously harass my family members and their children.

I believe that there are enough complaints posted on this website to justify a class action suit or at the very least filing of some form of legal consumer complaint. If anyone is aware of how we can make this happen please contact me ASAP. In the meantime I am going to purchase another vehicle just so that I can get from under the grip of CPS and their bully tactics.

The FDCPA DOES NOT apply to original creditors, only 3rd party collections.. KAY stop accusing people of not reading when it is YOU that is not reading...

It is very evident that there are people on this website that work for CPS. They have posted rebuttals on many complaints and they are always cutting down the consumer and sticking up for CPS. You need to look at the rebuttals and you will see what I'm talking about. We do have rights, lots of them, and don't let these jerks trick you into thinking that CPS is above the law.

If you idiots had actually read the post you would of read where CPS was calling her home WHILE SHE WAS AT WORK and harassed her children. She wasn't just sitting at home and seen it was them and asked her children to pick it up. IDIOTS!!!!!!!!!

As far as her talking to them at work in the Fair Debit Collection Practices Act of 2006 it states that "a debt collector may not communicate with a consumer with the collection of any debt at the consumers place of employment if the debt collector knows or has reason to know that the consumer's employer prohibits the consumer from recieving such communication." Section 805: Communication in connection with debt collection: subsection 3. If they have been informed not to call, this is harassment.

Also, in 806: Harassment or abuse: subsection 5 it states that "a debt collector may not engage in any conduct the natural consequense of which is to harass, or abuse any person in connection with the collection of debt. Without limiting the general application of the forgoing, the following conduct is a violation of this section:" (subsection 5) "causing the telephone to ring or engaging any person in the telephone conversation repeatedly or continuously with intent to annoy, abuse, or harass any person at the number called."

And you have obvisously NOT read any of the other posts where people have stated that they DO talk to CPS and they TRY to set up some kind of arrangement with them only to have them call them back in the matter of minutes or hours asking for the same thing and not finding anything in the CPS "records" to show that they have just been contacted and what was said. This is poor practices and management on CPS's part. Most of these people were only behind by a couple of weeks or month and was trying to work something out with CPS because they are HONEST, hard working, people and trying to make their payments but fell onto hard times. As far as why they "picked" CPS, they didn't, they, like my husband and myself, didn't know about this company and how they worked until it was too late. This does NOT give CPS the right to degrade them, threaten them, harass them and put their personal information out there to strangers, coworkers and family.

I read these rebuttal's, but what those responding do not undersatnd is that we all DO answer the phones and they obviously have never had to deal with a company such as this. It does not matter if you answer the phone, if they do not like the answer you give them, they will simply start a round of harassing calls to family, friends and your work.

They have a scam, and have someone call and "pretend" to be from repo company and on way to get vehicle ( we want to surrender it) than never show and within 30 minutes CPS calls and wants to make another arrangement that they know will be impossible for you.

This company simply put needs to take a Ethics Seminar, they need to learn what the term "Customer Service" means. They are taking advantage of people that simply may have had a hard time and needed their help in obtaining a car loan, that does not give them the right to treat us like dirt or scum. We are still human, and EVERYONE has hardships in their life including CPS employees.

I have been trying so hard to find an attorney that will start a class action law suit they have laws against the type of harrasment and as far as others saying answer the phone it does not matter if you answer the phone they will still continue to call. They give out my personal information and even proceeded to curse my boss at work and say that they can call my work ultimately I lost my job! I cannot take it anymore they have really really gotten under my skin, I have contacted the attorney general but they only mediated the situation and not helped me at all. Laws are made to be abided by and we have to so why can they just do what they want to do? Please if anyone knows of any actions taken inform me.

CPS should stop calling the OP altogether and simply repo the vehicle.

They'll sell the car at auction for a fraction of what it's worth. Then they go after the OP for the remainder of the loan balance PLUS the repo fees, towing, auction fee, etc and ANOTHER round of phone calls will begin anew to collect this remainder.

if a company has to call you everywhere, must mean you arent answering the phone and talking to them. i know if i owed you money, avoided your calls and you had to track me down then you would cuss my butt out, right? and if you paid all your bills on time, why did you have to get the loan with CPS? they do 2nd chance loans. higher interest with bad credit. so doesnt sound like you are telling the whole story. i agree with the digust with using children to answer the phone. what are you teaching them. that its okay not to pay your bills then avoid calls. i owe tons of debt. not proud but its the truth. but when they come calling i tell it like it is and keep it moving. when i get tired enough i will send a cease/desist letter. i've done collections myself and treat people like i want to be treated. i can respect a person for being honest then having to track them down to get them to pay while they a depricating the car i might have to repo. you have to consider....the dealership got paid up front, you signed to pay it all back, you are driving around payment free and avoiding calls. what more do you want?????

Seriously, people like you disgust me. No one makes them answer the phone but you do condone it. And, if you don't want them talking to the 'children' then take the call at work.
What is their punishment for answering it? The 18 year old isn't a 'child' anymore so there is no issue there. The other 2 have no reason to answer it. You certainly have an answering machine....who doesn't in this day and age.
YOU KNOW these clowns are going to try and call you at home and everywhere since YOU KNOW you are behind in payments.
