Ebay Ebay.com, paypal, paypal.com, my cash card Allowed postal fraud, would not help consumer, allowed theft of a moneyorder by a seller san jose California

 I purchased a smart phone on Ebay from one of their verified ebay sellers whos ebay id is Graysellingsdot4 or his actual registered name Richard Eckendorff. I had planed to pay vival paypal for this purchase but could not get the paypal my cash card to work so ask the seller if he would accept a money order or cancel the sale, the seller said he would accept a moneyorder and sent an address to send it to.

I purchased the money order sn#51013590311 and mailed it off to him, two weeks past and no item, I emailed the seller and he said he was out of town, a week later I again emailed and no reply, I then filed a complaint with ebay that I had not received an item so they opened a case and said they would stand behind the sale if the seller did not send the item.

Another few days past and the seller notified me that he would pay part of the refund, I told him I wanted a full refund, he then contacted Ebay and some how talked them into closing the case saying he had not been paid but yet he had the moneyorder and appears to have cashed it.

I again contacted Ebay and they then informed me that regretfully they could not stand by the sale as I had paid by moneyorder and they only guarantee items purchased using Paypal, that is not what their buyers protections says, they are suspose to protect all buyers regardless of payment method.

In this case Ebay has allowed the seller to keep the moneyorder and not ship any item and allowed him to do so with impunity. I feel I have been robbed and Ebay has help the person commit the crime and get away with it.

I have coppies of all of the sellers replys and the copies of the ebay complaint process, I send photo coppies of the moneyorder filled out to the seller viva the offical ebay email yet he said he did not get it, a week later he sold the same type phone again on Ebay, this is no less than theft.
