I have been fighting with this company since 2002. The latest is the third time they have reported that I have not made my payments. I can show that every payment has come through my bank. I filed chapter 13 bankruptcy 2 years ago in June to save my home. This is the third time that that they have incorrectly recorded my payments. The last time the judge threatened punitive damages but this time they are not filing a suit against me. They are simply sending me a statement that these fees (2500) and my unpaid payments are added to my debt. I have only increased my debt despite making payments to them through the trustee. I cannot find a lawyer who is willing to fight this company. I want to be part of any class action lawsuit and have kept all documentation. My bankruptcy was due to them, the stress of this has been unbelievable as I spent two years in foreclosure paying outrageous payments. I can show the amount of money and can show how inept and criminal their book keeping is.

I can sympathize. My husband and I filed Chapter 13 in November to stop foreclosure and in both May and June they filed Stay of Reliefs stating they haven't received the monies owed. I sent copies of cancelled checks each time showing that they received the money. It did not help that it is taking them 3 weeks to cash the checks once mailed and now, the last two checks shows that someone changed the first number of our account so who knows whose account that money even posted to!
I am keeping records of everything that we receive and I fax and am now going to send all checks certified w/ signature to prove the length of time in posting payments. We are trying to schedule a meeting next week with our lawyer to see if we have any options here.

Hello Katie,
If you're fighting mad and willing to do battle with your mortgage company and loan servicing company then meet me at Joe'Platoridge.community farm. There is no need for you to wait for Homecoming Financial and/or GMAC Loan Servicing to file an action against you to get the court to address the problem(s) you are having with them.
You should file a motion so that the court can become aware of what these companies are doing to you. I just happen to have such a motion that you can use as a guideline, but you have to contact me so that I can share it with you.
Undoubtedly, Homecoming is violating the automatic stay imposed by the bankruptcy court. If the judge threatened punitive damages before, hopefully, he'll slap them with punitive and exemplarily damages this time around.
Again, meet us at the farm. We gather there to help each other by sharing are experiences and knowledge.
