After a year of carrying my loan with Triad, I unfortunately expericenced more bruises in my credit. Trying to find contact info, I came across many of the posts with people's experiences with them. It really got me concerned with what I had gotten myself into.
All of the 'bad' experiences I was receiving from them at that time, I contributed to my own handling of the situation. I do not think that they did anything out of the 'norm'.
After another year, to year and a half, my credit & employment situation had turn around. I was able to refinance my vehicle through my credit union, less then half the APR, will be repaid 6 months sooner and a lower payment than I was paying.
Now almost 6 months after payoff, the credit union has not received the title(as requested above endorsement area of payoff check), nor has it been released to me.
I am now getting letters from my credit union stating that if they do not receive title showing them as the lien holder, my loan will have to be converted to an unsecured loan (so much for saving money!).
IF YOU ARE NOT ALREADY INVOLVED WITH TRIAD FINANCIAL - STAY AWAY!

Fortunately with regular communication with credit union, they worked with me to prevent refinance rolling into an unsecured loan.
After nearly a year of calling Triad weekly requesting TITLE and/or LIEN RELEASE it has happened.
I am glad to be free of this company. My collections experience with them was due to my actions; at no time, in my opinion, act unethical. Very disappointed in the actions after pay-off.
Stay within terms of ANY loan with ANY lender and we will not have these issues to deal with.

I don't think that they are actually changing the terms, Mike. I guarantee you that the finance agreement was contingent on the CU being able to attach a lien to the vehicle, and provided for reversion to an usecured rate should the security interest become unavailable.
In legal terms, obtaining the security interest was a "condition subsequent" to maintaining a secured rate APR. This is not only legal, but makes sound business sense and is not on its own a ripoff. The financier's risk of loss increases in the absence of a security interest, and the rate on the loan must be adjusted to reflect that.
The consumer's beef isn't with the credit union, who seems to be acting within their rights. Rather, the offender here is the entity tnat no longer has a legal right to a lien but continues to assert it nonetheless.
My advice to the reporter would be to take the lienholder to small claims court. Seek an injunction forcing them to remove the lien or a judicial order forcing the recorder to remove it. He should also seek any damages incurred as a result of this (which would be the cost of filing suit, any increased financing costs, and any other costs unecessarily incurred due to this debacle).

Right now, it is their problem that they can't get the title from Triad. Continue to pay them the same payment that was agreed at the time of refinance.
Of course after you pay off the car or if you want to trade it in, you'll need the title. And then you might have to sue someone if it's gone that long.
If the CU is going to make it an unsecured loan at the same APR that's a good deal for you, but it then becomes your problem to get the title to the car you paid for.

send the title that the check paid for, isn't that fraud of a chartered bank? Have you called anyone- like the AG or ?
