OK, so.....

AUTHOR: Tony - (U.S.A.)

I tried to give you an objective opinion, but you took it as an insult without understanding my point. I did not know all the facts and that's why I gave you some different scenarios. I hate to take anyone's side here, b/c I hated working for those companies. However, your situation is not uncommon. If telling the truth hurts and makes me an a*****e, so be it. Let's see if this helps...

If you don't like the product or the service you are getting, just return the stuff. YOU SHOULD HAVE DONE IT A LONG TIME AGO! Obviously, they were jerking you around about getting it repaired or getting a new replacement set, and they are to blame there. Yet, you continued to pay them for 7 months, and you are to blame there. If you have other accounts, turn in the one account (LVR) and only pay on the others. They cannot apply $ to a turned in account. They will tell you not to turn it in b/c you've already put so much $ into it. SAY NO! If they talk you into keeping it, then you'll invest more $ into something you don't like. Where does the insanity end? Be prepared to cut your losses and let it go. Forget about a refund. Their contract says you are not entitled to one if you return the merchandise. You rented the property, you got use out of it during the rental period you paid for. Your signature on that agreement says you agree with this. Your signature also says you agreed to its condition. A lot of people complain about the agreements, but they sign them anyway. Once signed, you aree to all of their terms whether you read it or not. Unless they held a gun to your head and made you sign it, you're out of luck.
I promise you that if you tell them to come get it, they will do something at that point. If by some RARE chance they don't, then you won't spend any more $ on something you don't like. Think of the $ you'll save! They might try to get you into a new set now, but your payments and term will likely go up. The reason why is because now the set you have is over 7 months old, it isn't new anymore. Again, you'll end up spending more $. If only you had done something a long time ago, you'd be in much better shape.
Now you said a "warranty company" came out to take a look at it. Was this the manufacturer of the LVR? If you called the MANUFACTURER and they actually sent someone to your house, they would step in and make sure it is repaired under warranty. This would make your problem with the manufacturer and not the store. And all of this is just plain stupid. If it was some other company, then their warranty opinion is pretty worthless because its not their product.
Now about the phone call. If they left a message on someone else's answering machine that said you would be arrested, then I hope you saved that tape! Go see an attorney. Of course, that costs more $ and that's why many customers won't do anything when they have been wronged. In America, you have rights, but in the legal system, you have about as much rights as you can afford to pay an attorney for. If you don't have the tape, then forget about it. They were wrong, but you can't prove it.
Oh yeh, you could take them to small claims court, but you'll likely lose that case. First, because of the rental agreement you signed. Second, and more important, you paid on it for soooo long. A judge is going to tell you the same thing I'm telling you.
I know this is probably not the answers you were looking for, but I'm trying to save you time, effort, and $$$$. If you've been complaining about it for over 7 months, and they still haven't done anything, then RETURN IT! Yes, they should've done something a long time ago, but didn't. You should've returned ut a long time ago, but didn't. I know that you think you'll be losing money, but how much more are you willing to lose? They will keep accepting payments as long as you'll pay them. If you pay it off and it never gets fixed, you'll be even more upset. Whatever you do, good luck!

#1 Consumer Suggestion

What is wrong with you?

AUTHOR: Tony - (U.S.A.)

I am a former store manager of Rent-A-Center and former Ast. Mgr of RentWay. I never worked for Aaron's, but I know they are pretty similar. Here is my objective opinion.

First of all, you never stated what the "damage" actually was. Second, and more important, why the hell would you pay on a Living Room Set (LVR) for 7 months knowing that it was damaged? Next, did you rent a "new" LVR and receive it damaged, or did you rent a "previously owned" LVR that was already in that condition and you now have buyer's remorse? I think the 2nd is the more likely of the 2 scenarios. If you rented it in that condition, it's your own fault. You knew the condition before you rented and agreed to pay the price they are charging you. If you signed an agreemant that had the words "used" or "previously rented" or anything like that, then you don't have much of a leg to stand on. The agreement clearly states that you accept the conditon of the merchandise that you received.
If it was actually new and was damaged during delivery, I could understand them telling you that they would get it repaired and not ever doing it. But after SEVEN MONTHS???? I still think its your own fault for paying on it for so long. I could see a month maybe, but 7?? Geeezzzz Why didn't you return it a long time ago?
Just tell them to come get it. They will probably try to convince you to keep it, maybe even offer a discount. They might even be inclined to actually repair it. But even if they do come get it, they WILL call you back in a week or 2 and offer to re-deliver it back to you. Customer retention is the name of the game in the rent-to-own industry. Unless you are one of those irate, a*****e customers who always cusses out the employees every time they call you when your payment is late, then they may just want to pick up the stuff and be done with you. There's always 2 sides to a story and most customers tend to leave out the part where they were in the wrong. I dunno, I could be wrong about your paricular situation without all the details. But, all the RTO stores I know of are required to telemarket to picked up customers and try to convince them to re-rent the stuff and pick up payments where they left off. Most of the time, you do not lose the amount paid towards ownership if you return it. It's called Lifetime Reinstatement.
Oh yeh, if you are late on one account, they can refuse payment on another one. However, you can tell them to come and get one and that you want to pay on the other. They might reconsider. Or you could just tell them to come get all their stuff out of your house and go to another rental company.

Now...them telling a friend of your's that you could get arrested. That was just plain wrong. Probably an employee who got pissed off at chasing you for your payment and slipped up and said the wrong thing. The company has strict rules against that sort of thing, but unless you have some proof (like a recorded phone call) then it will be tough to prove!

My suggestion is to go to the corporate website and file a complaint if you still think its not your fault. The address www.shopaarons.com. Then call the # 1-800-950-7368 (that's 800-950-RENT...LOL) and complain everyday until someone calls you back with an agreeable resolution. Do not get excited and call the store. Someone from corporate will call you back, they have to. It just may take a few days. Or, like I said, just go to another rental company. Chances are you'll have the same issues there, but if you tell them that want to go somewhere else, they often change their tune! Good luck!
