My daughter's vehicle was backed into in a parking lot by an Allstate insured, who admittedly was on the phone and not paying attention. When it came down to Allstate paying for the damage to my daughter's vehicle Allstate claimed that they find my daughter 10% responsible for the accident due to the fact that she never hit the horn to warn their insured.

Therefore Allstate decided that they would only pay 90% of the claim and that my daughter would be responsible for the remainder. I tried to argue the point with Allstate but they would not move on it, she either accepts the 90% or fight it in court, which would have cost more than the 10%.

All of the insurance people I had explained this to had never heard of such a thing but were not surprised when they had heard that it was Allstate that had done this.

If so, let your company pay you (less the deductible). Then if your company is a member of Inter-company arbitration they can arbitrate Allstate for your companies money and your deductible. Allstate will lose the arb at 100% IF your daughter did nothing to contribute to the accident.

If there is no collision coverage on the car. I would suggest trying to talk to the adjusters manager and reason with them. No yelling etc. Tell them that your daughter had no time to react as it happened so fast. Also the point of impact may help you, but your post doesn't give those details.

If that doesn't work consider filing a small court claim (depending on the $ amount check with your county courthouse). It might cost a $40 to $100 filing fee, but depending on the amount of the claim it may be worth it. Once the other driver is served the lawsuit they will turn it over to Allstate to respond. Allstate has more lawyers than they know what to do with, but none of them are going to allow a lawsuit over what I assume is a rather small amount of $ (to Allstate, at least)to go forward. Odds are the attorney will tell the adjuster to pay the claim. In most cases, you won't get the filing fee back so you need to factor that into your decision.

Most Allstate adjusters are forced into being equal opportunity a-holes because of the corporate culture there.
