My Car was repoed by Americredit in Feb. I got a letter today stating that the car was sold at private auction for 6600.00. After paying on the car for 3 years they say i still owed 15,000.00. I now have a balance due for a little over 9,000.00. Not much less than what i purchased the car for. Anyway, has anyone ever had their wages garnished for the amount owed or is it Americredits practice to show that amount as a charge off on a persons credit report?

Its Their Fault, Right?

AUTHOR: Douglas - (U.S.A.)

POSTED: Sunday, April 29, 2007

Apparently there is little or no understanding of what you got into. Americredit is a sub-prime lender...they specialize in financing vehicles for people who have bad credit. People get bad credit because THEY have a HISTORY of paying their bills late or not paying them at all. Because there is more risk to Americredit, the interest rate is higher. The reason you owe so much after the repo is because you were UPSIDEDOWN in the deal. This happens because YOU put little or no money down or you have a loan contract which is too long. All this is very obvious IF you take time to read the contract and use a calculator to figure the numbers. If they sue you for what is left over after the sale at auction, one of the possibilities they have is to garnish your wages. Whether they can do this or not depends upon state law. To say Americredit needs no reason to repo is just plain stupid. They make their money from your payments. If you make those payments on time, they make money and they are happy. To repo a car costs money. To sell it at auction then going after the debtor for the deficiency means they will just about always loose money.
