I don't know where to begin this company. I will start by telling you that I am a professional small business owner so I understand the importance of customer service and what it means to the success of my business. I became disabled about a year ago due to a car accident that was of no fault of my own. You can only imagine the impact this had on my entire life professionally and personally. Due to savings being my only income and that running low and me prioritizing my life, I contacted Gm financial (AMericredit) myself before falling behind on payments and informed them that I was dealing with a financial hardship and they could note on my file and update my employment/ financial situation and address because I had to move in with a caregiver following my accident .. I'm talking I've hit complete rock bottom.

After a month of falling behind and the harassing phone calls I told them I was waiting for money to come in, a settlement from GM due to a lemon law claim (which is a long drama within its self. CLASSIC CHEVROLET SUGARLAND,Tx- DO NOT BUY A CAR FROM THEM, THEY SOLD ME 2 LEMONS this car I'm writing here about being one of them. I'm talking I've taken this car a 2015 Chevy Trax in 18 times to the same dealership where purchased in less than 4 months for malfunctioning break issues, so they settled on a small amount of 5k which more than half went to a lawyer. They should have been buying this car back in the lemon law claim seeing that they bought the first one back & put me in this one. So I feel in some way this is retaliation & them getting the car back at my expense!)

So at the time this money was the only thing extra I had coming in and I wanted to use it to pay the note I was behind. I have yet to receive the check from that claim! I ended up falling a 2nd month behind on my payments and I called them on April 24th to see what my options were to keep them from repoing ....because I hadn't heard from GM financial and everyone knows how they will harass you when you're late! The representative I spoke with said there was nothing she could do because I couldn't provide payment then, and that it would continue into repo status. I explain to her I can't lose the car my caregiver and I use it to get me to and from my appointments and things so there had to be an option and she insisted there was nothing. Like really no sympathy for anyone? I asked to speak to a manager and a guy name Steve presented himself and offered the deferment option! I said ok and he explained the terms. He sent me an email to accept the deferment and send back with a pin he provided and a 1-800 # to call and make sure it was accepted! I provided him with a post dated check, which he agreed to take. I called about 36 hours later as directed, the deferment was accepted.

So at this point I'm assuming everything is fine! May 10th I called the office to see if I could give them another account number to draft the payment because someone was going to lend me the money and allow me to to draft the payment straight from their account. We spoke to Shirley and she handled the transaction, I explained to her I needed to cancel the check on file so it wouldn't bounce and draft the payment as described before! She took care of this and told me everything was fine and that my next payment wasn't due until June, ok thanks! Again I assume everything is ok, until today June 15th I get an email from Onstar that may car had a theft alarm go off twice. I call Onstar to see ad THEY inform me that my car was repossessed!

So of course I AM PISSED! I paid the deferment, and was told multiple times it was approved, and it drafted from my friends account on 5/15! I immediately dial GM FINANCIAL and SEAN in recovery solutions is being of no assistance! He tells me there is no manager around to see what went wrong! He told me I was wrong about my deferment plan date then he realized I was right and didn't apologize for accusing me of being wrong! He EVEN admitted that the deferemnt was in place properly and "someone" should have cancelled the repo filing and they didn't! He tells me he would send an email to Steven his boss to check into it! I asked him how this happened and what recourse do I have seeing that GM is obviously in the wrong here! He had no answer but that I would have to trust his word and I told him that wasn't enough seeing my experience with this company! At this point I NEED HELP PLEASE! I AM SO PISSED and I don't know what to do! I did my part and GM still screwed and now I am left with nothing!

The ONLY Relationship

POSTED: Sunday, June 18, 2017

The ONLY relationship which exists between you and this SUBPRIME lender is they did what they were supposed to do, fund your loan, and YOU were to repay this loan with payments on time, every time!  Thats it!

Since Americredit (which was acquired by GM) is a SUBPRIME lender, this is a dead giveaway this isnt your first time of NOT paying your bills on time.

Where do you people come up with this idea the lender is supposed to "help" you?  When you buy groceries does somebody from the store come to your place to help you cook it?  Does somebody from the clothing store help you get dressed?

The bottom line to all this is it is up to YOU to properly manage your finances so that YOU abide by the contractual agreements you signed.  Americredit is NOT your friend, you mother, your clergyman or uncle.  You agreed to pay ON TIME and they are holding you to it.  The ONLY exceptions are listed in the contract which YOU signed which fully indicated you agreed.

Before I forget, don't bother saying it, I DO NOT work for them!

The SPECIFIC law that they have violated.
The specific section of the original WRITTEN loan agreement that they violated.
The specific section of the WRITTEN deferment agreement that they violated.

Hopefully you can work something out.  If not and you have something then take them to court and sue them.  But I am sorry and you can say the law is on your side until the "cows come home".  However, if you have nothing to back it up that doesn't make it so.

You stated..."I did my part and GM still screwed and now I am left with nothing"

WRONG. Your part was to make every payment On-Time for the full amount. Where unless the loan agreement stated you had the right to change these terms if times ever got tough or you couldn't pay then you FAILED to do "your part". You don't get to "prioritize" what bills get paid and expect the companies to accept it.  If they do..great, but if they don't it is NOT a RipOff.  Yes this may sound tough and "uncaring" but it is the reality that EVERY fianance company would expect.

As just stated the reason you can't pay doesn't matter. Any issues you have with the car doesn't matter. Attornies taking 50% of your settlement doesn't matter. You having to move in with a Caregiver doesn't matter. As all of that is independent of the loan.

But with all of this said, this appears to have happened in the last day or so. So if in fact you did have a deferment in place and they did in fact reposess the car by mistake, if you get to the right people you should be able to get it back. However, even if they have one in place that may not legally override their right to reposess the car if they feel you are not going to be able to complete the loan agreement. After all what would happen at the end of this deferrment?

Is your disability status going to change? Are you going to be able to make the payments on the loan? If the answer is NO then the reality is you are just putting off the enevidable reposesesion and they may feel it is in their best interest to cut their losses now.

As for you being left with nothing. That is not necessily true. If you do not get the car back and they sell it at auction. If they sell it for less than the balance on your loan you will be left with a deficency balance that you will legally owe and they can take further action against you up to and including suing you in civil court.  Where of course you can plead your case in front of the judge but don't expect them to agree with your defense.

Good Luck
