I went to ATB tanning in June to get ONE session of the VersaSpa spray tan, because I was going on a weekend vacation and needed some quick color. I am extremely fair skinned and I told the girl under NO circumstances would I or could I use a tanning bed, because it burns me and it only makes my freckles darker.

She assured me the VersaSpa is what I wanted because it gives a nice color and it spreads really nicely, leaving no streaks or discoloration. I agreed, because it sounded like a pretty good option. I said time after TIME I only wanted ONE session, and I didn't want to sign a contract. I CLEARLY said I didn't want to begin a contract. Not only did she blatantly lie to my face about the contract (she actually called it a "FORM"), she lied about the price AND how long I was going to be paying. I was told I would pay one payment of 45.55 or something. She told me to fill out this "form" so they could put me in the computer in case I ever wanted to obtain a membership. I didn't mind, I obviously didn't consider she was LYING to me about this "form", and I was in a hurry to get a little color, so I gave them my card number, signed, and I thought all was good.

I used the VersaSpa Spray Booth ONCE. NOT ONLY DID I PAY 45 FOR THIS, BUT IT LEFT ME STREAKY AND ORANGE!!!!!!!! WHICH SHE TOLD ME UP FRONT IT WOULDN'T DO!!!!!

July rolls around and I notice ATB charged me 78.88 on my card AFTER I paid the 45. Naturally, I was confused and very shocked. I called them up, and come to find out the girl placed me under a 1 year VIP contract, which apparently includes unlimited BED tanning. Really? .....REALLY!? Not only did I tell her I wanted ONE simple session of the SPRAY tan, but I CLEARLY told her I could NOT use an actual BED. She lied straight to my face and purposely set me up for the VIP membership so she could get the top commission. Apparently the 45 was the STARTUP fee, and the 78 was the actual monthly fee I wasn't told about..

Now I'm stuck paying $78 a month for something I'm NOT going to use, and I'm only three months into the "form" should I say.. These people don't care who they rip off, as long as they get their commission out of you signing their "forms".

ATB has ripped off DOZENS and DOZENS of people!!!!!!! Don't get scammed and lied to like so many others!!!!! REPORT TO BETTER BUSINESS BUREAU!!!!!!!!

My advice to anyone with a similar experience: ask around about a reputable contracts lawyer, set up an appointment to explain your experience (bringing the carbon copy of your "customer agreement" if you still have it), and have the lawyer write a letter to ATB alleging mispresentation and fraud and requesting confirmation of cancellation of the agreement that they believe you have with them.  Be prepared to shell out $100-200 to pay a contract lawyer for writing the letter. 

I had a similar experience with ATB.  I agreed to only ONE MONTH of tanning, but later found out that the girl behind the counter had filled out my contract for 25 months total!

I currently have a contracts lawyer and am in the process of fighting it.  If it's any help to you or anyone reading this, my lawyer said that what's happened to us is very common with contracts: a salesperson tells a buyer/customer something completely different than what's in the contract, and/or, as I believe what happened in my case, the salesperson fills out parts of the contract after the customer signs. 

This is called "misrepresentation and fraud" under contract law.  ATB's Customer Agreement has the "non cancellable" protection clause and also has the 'the customer signs this agreement with no blanks' protection clause...BUT those clauses mean nothing under law!! 

Contract law PROTECTS consumers from fraud and misrepresentation, and the LAW is superior to any clause a business wants to put into their contract. Anytime anyone signs any type of contract that person has the right to contest the contract/business if they believe salesperson misrepresented the contract or lied to them.   

In my opinion, ATB puts those clauses in its Customer Agreement to deter people from seeking legal counsel and eventually freeing themselves from these fraudulent contracts.  People think they're trapped in their contract and have to pay.  That's just how ATB does business. As a business they have a steady income of monthly payments from everyone they've done this to, and that's prob why can afford to so rapidly spread throughout the midwestern states. And probably why they have a D-rating at the Better Business Bureau (look up their rating online!).

I can let you know what happens later lwith my case if anyone is interested, I hope to resolve it soon!  Good luck everyone!!
