I went to Bally's in Mesa to apply for a job at 7pm the day before Thanksgiving 2001. I was told I would have to apply for a membership before they would consider me for a job. I told them I was a student and didn't have a job and couldn't afford to join. They coerced me into signing a membership with the promise of a job. I paid $25.00 and applied. I didn't get the job.

I sent certified letter to Bally's Corporate Office in California within 3 days of signing. I thought everything was fine until December when an automatic payment of $34.90 came out of my checking account which caused 2 overdrafts ($29. each) on my account.

I immediately contacted Bally's Corporate Office and they denied receiving the certified letter (I had already received the signature card back).

I faxed everything to them again. Early January I called again to find out the person I talked to in December was no longer with the Company and was once again told they did not have any of the documentation.

I once again faxed this to them again. I had to cancel my debit card and my checking account to prevent them from taking further payments. As of February I am still being billed.

I contacted the Better Business Bureau and the Attorney General's office in California and Arizona. I received a response from the BBB quickly with Bally's response saying a cancellation was in place and money would be refunded within two weeks. That was a month ago and I still don't have a refund.

I don't understand how any business can get away with this kind of deceptive trade practices. I'm sure I am not alone and others too have struggled with similar situations.

I guess the only way to resolve this matter is to file a lawsuit against them which I fully intend to do. It is a matter of principal and I am not going to let them rip me off. Consumers need to be better protected against businesses that use these tactics. Stay away from Bally's Total Fitness - they couldn't care less about their customers!

Bally's WILL rip you off!

I joined Bally's 7 years ago with the understanding that I would only have to pay a maitenance fee of about $10 a month once my membership was paid in full (after 36 months of payments). During those 36 months, Bally's put me through HELL because they were not charging my credit card they had on file for me and then tried to hit me with late fees! I got into so many screaming matches with them--fortunately I had a friend that worked that there and was able to get it straightened it out (he was in upper management and said everyone was up to no good ripping people off--got frustrated and walked out.)

Well my membership is finally paid off-as far as my maintenance dues, they go up $1 per month per year for a membership that's already paid for--apparently this was stated in some very small fine print on my contract, but I WAS told it would only be $10 a month for life after the membership was paid. So in 15 years, I will be paying more in maintenance dues than what I paid for my regular monthly payments! I know people there who only pay $6/month for dues! They said the only way to get out of that particular contract is to quit and rejoin under different terms--no way in hell would I be stupid enough to do that--it's no wonder they have a very high turnover rate there.

Back in 1990 when i was 18 somehow i had gotten ahold of a free vick-tannys pass. When i desided to use my free pass to work out i was harrased not by one but a few sales people to join there club. One of the sales people was very flerty and convinced me that it would change my life and also added i would have a personal tranner and if i desided i didn't no longer want the lifetime membership i had 2 or 3 days to cancell the lifetime membership so i sighned the paper. I went back the next day and i asked for a trainer,they told me it would cost a hourly fee that i must of misunderstood.I was very upset and asked them to cancell they gave me a # so when i got home i cancelled my lifetime membership.

7-8 years latter a woman knocks on my door handing me papers telling me im being sued by ballys for not paying my lifetime membership.I called and told them i canceled years ago and they told me i should have done it in writing and i still needed to give them there money,well 4 kids latter a $1300 house payment bills up the but i couldnt pay, they wanted me to give them $900.00 right then and there or they where going to take me to court. I didn't pay and ended up in court.

The judge gave me a court order to make payments, well i did untill my husband fell out of a tree huntting and couldnt work for a year.I was not able to go back to work because i had a newborn baby 3other kids and a husband i had to do everything for because he could not move.so back to court i went.This time i had to pay attorney fees court cost and interest on my life time membership.I still couldnt pay what they wanted because i had to worry about food,not getting my utilitys shot off,but i did pay when i could.They still did'nt care about what was going on in my life,i started getting bounced check letters in the mail so i called the bank and they told me it was court orderd to take $400.00 to $500.00 out of your account.

I had no ideal that was going to happen 4 more times.I feel way behind on all my bills,I had to refinance my house to try to get ahead againand now that my LIFETIME membership is PAYED off they told me i cant use it.I payed off a lifetime membership and struggled very hard to do so, i should get my money back if i cant us it or be able to us it.
