Banana Hobby Charged Credit Card a month ago, still havn't sent order and don't return e-mails Los Angeles California

I placed a small order on Dec,29/07. One item was not in stock, so i recieved an a-mail from Henry, asking if i would like them to send part of the order,then send the other item when it came in stock. I returned the e-mail asking how long till the backordered would be in ? They returned my e-mail saying in a week they should have their order. I returned the e-mail telling them to wait to send my whole order. one week later i e-mailed to ask if they received their order, they returned my e-mail saying yes they recieved their order and would send my order in 2-3 days. That was Jan 11,2008. They charged my cc at that time. The order status still says will ship in 2-3 days and they will not return my e-mails.
