We had to close our business due to economic decline, so we closed our business account as well. For the last two months bank of america VISA and Bank of America loan department has been trying to access the closed account several times per day and now we have fees in excess of three hundred dollars. They have also been trying to access our personal account and we have over two hundred in fees. They said that they have the right to take any and all money out of our personal account to ensure they get their money. Is this legal? We gave them no authorization to touch our personal account. They called me and asked if I could pay them and I told them I get paid the next day, but I would only have enough to pay my home mortgage. They put in to take the money at midnight, but it didn't show online until the next afternoon. By that time I had already paid the mortgage. They got their money and my mortgage bounced. I am now closing my personal account with Bank of America as well. If anyone knows of a good attorney give them my contact info.

They have the right to offset any account at their bank with your name on it. They can take from your personal account to pay the business account, they can take the money from your child's account if your name is on it, they can take the money from your parent's account if your name is on it, etc. It doesn't matter if your name is 1st, 3rd or 10th on the account. They will take their money first, before paying anything else.
Not a good idea to have business and personal accounts at the same bank.
