2009 - Woman with no money, husband is cheating on me and decides he wants a divorce, so I borrow $25,000.00 from Bank of America credit card to pay lawyer's fees and have money to survive with my daughter until the divorce is final and I can pay the card off. Bank of America SAYS the money is going to be 0% interest for 1 year (of course, if payments are late 3 months in a row, the interest rate goes up, etc.). That is acceptable, because the payments are set up to come out of the bank account automatically, so I KNOW they are not going to be late. HOWEVER, Bank of America enters the WRONG bank account routing number so the FIRST MONTH payment does NOT go through, and they raise the finance charge/interest rate to 29%! This is NOT the 3rd late payment, but the FIRST late payment AND it is THEIR FAULT!!  My finance charge goes from $0 to over $900.00 a month!!!
As soon as I see this, I call and speak to MULTIPLE people at BofA. NO DICE! I can't afford a lawyer to get them to lower the rate back, or lower it AT ALL, so I am STILL paying off this debt!!!
IF there is ANYONE out there who can help me get ANY of this money back from BofA, it would be GREATLY appreciated! I am a single mom who is struggling with debt, and I need HELP!

Questions

AUTHOR: Robert - (U.S.A.)

POSTED: Monday, August 08, 2011

Just how did they submit the wrong number?  Every time I have had to set up an Electronic payment I have had to give them the account information.

Also, I have never seen a credit card give you 3 late payments, in a row, before you go to the default rate.  I have seen a few with 2, but most are "one strike".  Where with the promotional rates if you are late even by a day you get bumped to the default rate.  So was this 3 times something you thought or was it something in writing?

My finance charge goes from $0 to over $900.00 a month!!

- I don't know how you got that number, unless you are leaving something else out.  Because on $25,000 at 29% Interest the monthly Interest would have only been around $600 a month.
(25,000 * 0.29) / 365 = 19.86 a day in Interest.

As for "struggling with debt".  This happened in 2009, so even if there was something that could be done it is probably too late.  According to your post you would have paid $25,000 within the year.  Which even with the extra interest would have been a huge chunk of the debt.  So it is hard to see how much of your "Struggle" was caused by this two years later.

Physically go into a branch and talk to someone

AUTHOR: Steven - (U.S.A.)

Talk with someone face to face about this issue. Talking over the phone simply is not good enough for a situation like this.

Go in with documentation that you had attempted to have them payed directly as well as proof that they submitted the wrong bank account and routing number.

You do not need a lawyer to fight this. Who is telling you that (name and position)?
