Given every opportunity to tell me why I wouldn't sign the contract with MLS Realty, I was given no reason. I asked, What is the down side to signing the contract. Again, no down side. I asked all of the right questions and still, they never mentioned the possibility that I may have a lien placed on my property. They totally avoided the subject and for good reason. I am sure if they told everyone they were going to lien their property, they would get fewer contracts.
Give them credit, they didn't give me the time to read it and pushed it through (with the all positive and no negative) and got another sucker to bite. It was a no-brainer to sign it based on what I was told.
After 2 weeks, I just happen to search the public records using my name and there it was in black and white, the lien for 1 year. I asked them to remove it and they refused. They said it was common practice and it is not.
My advice, do not use them - ever. I have several attorneys who are looking at this and the fact that they have placed over 1000 lien's in the past year on properties in south Florida. This should be fun can you say class action?

You are a POOR missionary, but you have SEVERAL attorneys looking at your contract???

Ever heard of full disclosure? How about fair representation? How about they are my employer? Over 1000 people in South Florida had this done to them and I am betting I can get half to join in and go to a judge. Let's let the court decide. If I were one person - I would be scre_ed for sure. Laws exist to protect the people. The laws in real estate are specific to protect the people from these types of people and businesses. They claim this is common practice and it is not. I, in good conscience, cannot sit by now that they are exposed and do nothing.
I am sorry that you are working diligently to have me walk away. My wife and I are trying to sell our house and move to Haiti. We are missionaries and they know it and yet, they had no problem doing this to poor people wanting to give their live for a better cause (than ripping off people). She has been in Haiti since June and I am here trying to sell this house. If nothing else, the bad press will cost them. It will be my good will to see them closed and out of business. Want to help?

Why did you go over your legality questions with THE OTHER PARTY ON THE CONTRACT, not with your lawyer?
Why did you take what this party told you at face value and sign your contract without ever reading it???
The only reason a lien would be put on your property is if you did not pay up once your house sold. BuyOwner is NOT a free service, and you must pay according to the terms of your agreement.

If someone ever tries to RUSH you through a contract, WALK away.
If your rushed through and do NOT read it then sign it-it almost NEVER comes out good.

I agree that they played an underhanded maneuver on you and others, but the other Steve is absolutely correct, and a judge will agree too.
It is ALWAYS the responsibility of the CONSUMER to read AND Understand any conract BEFORE signing it. Many real estate attorneys will review a contract for you for a reasonable price.
Never do any real estate transaction without a buyers agent or real estate attorney.
There is no grounds here that I see to support a class action lawsuit.

Really? I admitted I was a sucker. I admitted I did not read it nor - nor was I encouraged. The point? I am not the only one and they are walking a thin line. All I have to prove is, they are doing this and not representing their client in an open and fair way which, by the way, is item #1 in the contract to represent me. I think it will be easy to come up with a few hundred people who have had this done to them. It was only a matter of time before their practice bit them and they chose the wrong person to make an a_s of!!!
