On 9/7/05, Cynthia Noeth, a company representative, came to our house and was given a tour. She assured me that with BuyOwner.com's aggressive advertising and competent staff, that our house would probably sell within a month.

A month went by and we received NO CALLS WHAT SO EVER! Moreover, I found out that the house had been IMPROPERLY ADVERTISED on their MLS as a 2-bedroom home and it is actually a 3-bedroom home. Additionally, the front yard is listed as the back yard on their virtual tour of the house. I was promised flyers and NEVER RECEIVED A SINGLE ONE!!! They took $3500 of my hard-earned money and now refuse to refund a SINGLE PENNY!!! All they care about is getting your money. They will tell you WHAT EVER YOU WANT TO HEAR JUST TO GET YOU TO SIGN THEIR NO REFUND CONTRACT. They get their money up front because then they don't have to worry about selling your house. They have your money and they don't care whether it sells or not!!

We have offered to reimburse them for any out-of-pocket expenses and to have our account cancelled but they STEADFASTLY REFUSE TO REFUND ANY OF OUR MONEY EVEN THOUGH I HAVE EXPLAINED TO THEM THAT MY MOTHER IS VERY ILL WITH ALZHEIMER'S DISEASE AND I CANNOT CONTINUE TO HANDLE THE EXTENDED BURDEN OF SELLING HER HOUSE WITH THE INEFFECTUAL HELP OF BUY OWNER!!!

At this time, I wish to report that someone from Buy Owner's upper management contacted me, and we have subsequently reached a mutally agreed upon resolution. Specifically, I have been granted a $2,125 refund of the original $3,500 I paid to Buy Owner.

Buy Owner has extended its regrets and apologies for what has been a difficult experience for everyone concerned. Personally, I will be glad to put this experience behind me. I have learned a lot through this experience and will hopefully benefit from that in the future.

If I have unduly maligned Buy Owner or any personnel thereof in any way, that certainly was never my intention.

UNLIKE BY OWNER, I HAVEN'T SOLD OUT!!!!!!

Well, on February 14th I received an envelope from Buy Owner, stating that they would refund half of the money I had paid them, $1,750 if I would retract my statements on RipOffReport.com and state that I was fully satisfied with my experiences with Buy Owner. I'm sorry, folkS, but, unlike the people at Buy Owner, I'm not going to propagate lies and the falsehood that Buy Owner is doing good business. I have received ABSOLUTELY NO RESULTS from the "advertising" these people claim to be doing on my behalf. So, in essence, I have given them $3,500 for NOTHING, NADA!!!!!!!!!!!!!!!!!!!!! THEY are very happy with their experience, but if I came on this Web site and stated that I was happy with my experiences at Buy Owner, I would be telling a GIGANTIC LIE!!!!!!!!!!!!!!!!!! Maybe these people can live with themselves in lying to the American public BUT I CANNOT. THESE PEOPLE LIED AND MISREPRESENTED THEIR COMPANY TO ME FROM DAY ONE!!!!!!!!!!!! THAT'S THE ONLY WAY THEY GOT MY MONEY. As much as I could use that money back, I'M NOT SELLING MY SOUL TO THE DEVIL FOR IT! KRISTINA KLEIN WANTS ME TO LIE AND SAY I'M HAPPY WITH BUY OWNER. SORRY, KRISTINA, NO CAN DO!!!!!!!!!!!!!!!!!!!!!!!!!!!!

The readers would like to extend their appreciation to BuyOwner counsel. Thank you for recognizing our preference for the formalism of an Answer over the readability and honesty of a rebuttal.

In response to your Answer, we, the RipOffReport readers, as intervenors, hereby propound the following interrogatories:

1) Please give the percentage of home sellers that utilize BuyOwner services who actually sell their property via said services.

2) Please give the average sales time for sellers who do sell their homes via BuyOwner.

3) Please give the average dollar amount remitted to BuyOwner for sellers who do sell their homes via BuyOwner.

4) Please give the average dollar amount remitted to BuyOwner by sellers who do not sell their homes via BuyOwner.

5) Please inform us as to why BuyOwner advertises its services heavily to home sellers, and rarely (if at all) to prospective home buyers. Specifically, please inform us as to whether this is because sellers can be charged far more to use the service than buyers.

6) Please inform us as to why your advertising appears to be so blatantly deceptive, and how you get away with such obviously exaggerated claims.

7) Please inform us as to why the actors in your commercials look like they are heavily sedated.

Not fair at all - just out for your money! ..just another legalistic pile of lies.

I was never sent any "proofs" at all. This is just another legalistic pile of lies. This company just doesn't get results and they tell you anything you want to hear so you'll sign on the dotted line and be stuck in their "NO REFUNDS" agreement. Why else would they have such an agreement.

So let me reiterate: Everything I said in my original complaint was true...EVERYTHING!!!!!!!!!!!! Anyone who chooses BuyOwner as a way to sell their home is in for a surprise--and I doubt if it will be a pleasant one. These people take your money up front--period. Once you sign, they're paid. They improperly listed my house as a two-bedroom home. The MLS coordinator didn't even know until I brought it to his attention. Don't listen to BuyOwner's legalistic defense of it's practices. The bottom line is that they goofed and they're not going to let go of my money.

NOTHING BUT FAIR??? Well, then, I'd say that you'd better look else where before you settle on fair!!!!!!!

I have a mother who is very ill with Alzheimer's Disease and I have pleaded with them to refund my money. These are inhuman people who DON'T CARE ONE IOTA FOR THE CUSTOMER. They care only to get your money. I got no results from their advertising and that is not what I was told to expect. $3,500 - you decide - is that fair? These are dishonest, uncaring people - not nice people at all. They may feel that legally they are in the right, but ethically THEY ARE WRONG!!!!!!!!!!!

BuyOwner takes all customer complaints seriously and is committed to providing first-rate customer service to its clients. BuyOwner has investigated Barbara's complaints and disputes her allegations. BuyOwner provided all the advertising and services contracted for by Barbara. BuyOwner sets forth the following facts in response to Barbara's complaint:

(1)An initial meeting was conducted between the client and a BuyOwner sales representative, during which the client selected the advertising that seemed most appropriate for the subject property.

(2)The client later executed a written contract that outlined the advertising, which she had chosen.

(3)On three separate occasions, BuyOwner sent the client advertising proofs to confirm that the proposed advertising was correct. The client failed to return any of the proofs to BuyOwner. As a result, the mistakes alleged by the client's complaint could have been corrected before the advertising was issued, but she declined to review the proofs.

(4)BuyOwner did not learn until Barbara posted her complaint, herein, that she did not receive the flyers that had been previously sent to her. When BuyOwner offered to resend the flyers to her via overnight mail, she refused.

BuyOwner is committed to keeping its customers happy. To that end, BuyOwner offered to refund part of the contract price, despite having provided all of the contracted services to the client. However, the client refused the offer and has refused to work with BuyOwner to try and remedy the situation. BuyOwner is confident that it has done everything it could do to assist this client in the sale of her home. Simply put, BuyOwner published and provided all the advertising and services that were contracted for by the client.

Half a rip-off

In all fairness, I have to update this rip-off report. Buy Owner offered to refund half of the $3500 they swindled me out of if I'd remove my rip-off report, as well as withdraw my other complaints against their unethical business practices.

Well, as far as I'm concerned, half a rip-off is STILL a rip-off. They refused to document any out-of-pocket expenses for setting up my account. The truth is, even at $1750, they are coming out ahead. Their advertising has been totally ineffective and they still have my $3500. After all the aggravation I and my family have endured and wasting a complete month with their botched up advertising, $1750 is just adding insult to injury.

The moral of this story: BUYER BEWARE OF BUY OWNER!!!!!!!!!!!!!!SAVE YOURSELF A LOT OF MONEY AND A LOT OF FRUSTRATION AND AGGRAVATION AND GO TO A FOR REAL REALTOR!!!!!!!

Buy-Owner is not that great

You should go with Assist-2-Sell. They don't require any upfront monies and take $2900.00 at the end, or a 3% or so commission if it's listed in the MLS. I know here in Florida, properties seem to sell very fast with them. But the Buy-Owner properties seem to be posted forever, plus, they don't update the website when a property has an offer. Some of the stuff out there is really old, and has been sold for months.
