I too have had the same problem with Capital One's "payment protection" program. I lost my job in December of 2000. I kept up with my payments as long as I could using money I had in my savings so that I could use the full benefit of my payment protection program I had paid for almost my entire time with Capital One.

Once I got to what I call my "red line" I called Capital One to implement my payment protection program. I was given a website to go to in order to file my forms online by the first rep I spoke with. After trying to pull this website up which is not even a valid web address I called Capital One back immediately thinking I had written it down wrong.

The next rep I spoke with knew nothing of this web address and advised me they would mail me the forms to fill out. After months of not getting the forms and spending countless hours (yes I said hours) on the phone with Capital One I realized I was making things worse on myself as I now had ran up a cell phone bill from hell trying to get something I paid for in the first place.

I was told anything and everything from the forms were never mailed to "we're not responsible for the USPS".

My accounts of course have now gone to collections and they are now threatening me with court proceedings. I say bring it on due to the fact that I paid for a service they've refused to give me. The collection agency offered me 40% off my bill but I didn't agree to that as I don't think it's fair to take 40% off a bill that's almost double what it should be after the late fees and interest rate on the total balance. They also advised me that if I lost in court and still refused to pay they would just pull it from my pay check.

At this point I have received some advice from a friend who now works in a receivables management position to write letters to any and all executive level employees of Capital One that I can. That is where I am right now.

Will this help me at all or is going to court and possibly facing paying court fees on top of this my only option?
