I was barely making it financially but was overdrawn on the checking account. I have neurological problems including a brain injury and things like this happen. A relative sent me some money to help. It was just short of my being able to pay my Capital One card and caused me to be unable to pay them. Now, I'm in a better financial situation.
I had a credit limit of $2000 and the balance was $1999. Capital One added interest making the card over limit. They then hit with fees and interest charges. The debt was given to NCO Financial which is a debt collection company. Capital One then took the debit back! They added even more late fees and charges and kept right on doing it. The debt was charged off and was placed on my credit report and they keep reporting it as bad debt and ruining my credit rating.
During the course of the debt, I received a statement that there was help available. I called the 1-800 number. It was Customer Service but outsourced to India. I was under the impression that I could arrange some sort of payments. Instead, the person said that my minimum was $400 and then asked how was I going to pay it. He also had asked for the the last four numbers of my Social Security Number. Before I go any further, my question is how did he have my SSN or access to my SSN and is this even legal?
A charge off doesn't make the debt go away. The credit card company can sue you as a charge off eliminates the Statute of Limitations. The charge off will be dropped from your credit history in 7 years but you are still legally liable for the debt. That means that the creditor could sue you and take you to court any time for as long as you live! No wonder they took the debt back. I have also received a 'legal notice' about being sued. It was pure intimidation and I kept the notice. Like I said, they keep reporting the debt as it increases. I keep getting statements for the past due account as they can do this to collect the debt. After what they've done and are doing to me I gave up on them. I've read the things here about Capital One and even paying them off means trouble.
The collection of the debt has now been turned over to the Salt Lake City Utah branch of Capital One. Utah is pro business and goes out of their way to get businesses here plus gives them attractive tax breaks.

- Well I give you credit I think this is the first time I have heard the "brain injury" excuse. I will say that you seem to be a lot more coherent and have better writing than a lot of other reports on this site for people who don't have any injuries.
But let's deal with the Credit Card. They allowed you to borrow up to $2,000 of THEIR money. They didn't force you to spend that money did they? Nope..you spent that of your own free will. So interesting how you said you got to $1,999. Did you think that because you only had a $2,000 limit that they could no longer charge you any late fees or interest? When you didn't pay they did what EVERY other credit card would do. Turn you over to a collection agency, and report you to the credit reporting agencies.

- They had your SSN because they got it from Capital One, who got it when you applied. But it is very unlikely that he had all the numbers, it is likely he only saw the last four numbers as well.

- Has nothing to do with the legal agreement you made when you opened up the account with them.

- You have a few things mixed up. A Charge-Off is just an accounting term that basically says they gave up trying to collect on this bad debt. You are right it doesn't make the debt go away, but it also does NOT eliminate the Statute of Limitations. As long as you do nothing to reset the SOL(such as making a payment) there will be a point where if they attempt to sue you, you can use the SOL as a defense to have the case dismissed. The SOL varies by state and for Credit Cards it varies from about 2-10 years with a majority of states in the 3-5 year range. This is NOT the same as your credit report, this is going to be 7 years and is the same for all states.
Now, once you are sued and have a judgment, depending on your state they in effect could attempt to try and collect on it forever.
I have also received a 'legal notice' about being sued. It was pure intimidation and I kept the notice
- I hope this notice wasn't a summons. If it was I hope you did more than just keep it, I hope you went to court.

A mistake

First off let me just say I do not now nor have I ever worked for Cap One or ANY other credit card or financial institution.
Second....Cap One didnt ruin your credit----you did. I realize there may have been extenuating circumstances but you defaulted on paying a credit card that YOU used. They seldom ever go away without being paid. You might try contacting Bud Hibbs and see what he has to say. If anyone can help you He / his web site can.
Ive been a Cap One card holder for more than 10 years. They helped me to restore my credit rating after a nassy divorce many years ago. I went from a credit score of 300 to a current day credit score over 800. Yay Me........I worked hard to get there and will never return. BUT to do it............I HAD to fess up and pay my bills...old and new and had to keep everything paid. I have a couple cards today for emergency purposes but now I refuse to buy something if I cant pay cash.
All that to say.....YOU CAN TOO......but you cant blame others and you cant just not pay your bills. Good luck in the future

You gave it to them when you applied for credit. You're quite the piece of work. :-)))
