The whole reason these devices were outlawed here in FL was a violation of privacy issue.

The way these devices were being used, they could actually keep a record of wheree a person went, etc. all in real time. You could actually follow someone around and track their activities, etc.

As far as the dealer's incentive to disclose? That's easy. It keeps you from getting sued!

The customers incentive to agree to installation? Maybe better finance terms.

I were the dealer, I knew about the law, and told my customer there was a GPS device in the car?????  I can't see how this makes any sense unless the customer (a) told about the GPS, AND (b) waived the fact the GPS was installed.  Otherwise the dealership would have been out of business a LONG time ago....  If I wanted to secretly protect my investment and leverage my ability to collect, that's another thing and it makes sense (breaks the law, but hey...) given the point in the transaction, but then why would I let the customer know about the GPS??  I mean it all comes back to that point....??

I would agree, they need to be sure they didn't sign a consent before jumping off with a lawsuit.

I know for a fact that most of the buy here pay here car lots use these devices without the knowledge and consent of the customer because there is no enforcement, and no penalty when you get caught.

This law is a toothless tiger just like the do not call list. There is no way of actually enforcing it.

The ONLY remedy is to make it a civil matter and recover actual damages.

SHouldn't he check his contract and paperwork to see if he did sign a waiver before sueing them? Its highly likely that they did have him sign something saying he agreed to it. I mean, its worth checking before wasting money on a lawsuit.

Sorry to hear about this. But there is good news!

Get a lawyer right now and sue them for your damages. Your legal rights have been violated.

Contact the licensing division that regulates car dealers and talk to them about it.

Time to educate a bottomfeeder!
