We had received a phone call regarding getting a credit card machine. After signing the paperwork, which of course was a non-cancellable lease, we received the machine. The machine never worked. We ran 1 credit card transaction and it never went through. We spent hours on the phone trying to get it resolved, but still nothing.

Then we started telling them that we wanted to cancel, explained why would we want to pay for something that did not work, but they just kept siting the non cancellable lease. After numerous phone calls, they finally said to send it back, which we did.

Then came the threatening letters and phone calls from their collection agent. I finally had to hire an attorney to send them a letter.

But here is the kicker, they have reported it to our credit report as a charge off. They have the machine back to unfortunately sell to some other unsuspecting business. Am I able to get the incorrect reporting off of our credit report, after finding this website, I seriously doubt it. How can this company continue and I want to know, how do I sue them!

CORY Get Your Facts Straight about CIT Lease Finance Group

This is Primarily to Cory.. First of all the CC company didn't sell their lease to CIT. CIT is a primary distributor of POS or Credit Card equipment to Independant Representatives. I've even heard people say they are a Third Party. However, in our case our name was fraudulently put on the CIT Contract plus the Independant Representatives name and Number. So if you know anything about Contract Law, this is no longer a third party senerio..

Secondly, since the equipment did not work, which is saying the same as product was not delivered, according to the Comercial Codes (at least in California) The Non-cancellable lease can be cancelled. The buyer only has to pay 10% of the Fair Market value. Which in our case, a person can buy the machine for 300 or less. Which if one does the math, this is 30...

Finally, you sound like you work for a company similar to CIT???????

Please file a complaint with the FTC. My company filed as soon as I read all the complaints against CIT. CIT may not be responsible for selling the actual equipment but they are very aware that they are doing business with fradulant processing companies and they do not seem to care that small businesses are being targeted and manipulated into costly leases as long as CIT is making money I brought my situation to CIT's attention 4 years ago and they still are supporting the same processing companies.

I'm going to stay out of the lease aspect because we've heard enough about CIT and their leases. The company that sold you the CC machine is responsible for the CC machine. How come you don't mention them in the post. If it never worked , there should have been some type of warranty involved. CIT has nothing to do with the CC machine's functioning or not. Who made the phone call selling you the machine. That company sold you the machine and sold the lease to CIT. So let's get the facts straight. The lease is a whole different matter.

You may want to sent a complaint to FTC (Federal Trade Commission) . I did and received a response saying they don't do individual cases. However, if they log enough complaints, they will start an investigation and possibly legal action. So here is the link: https://rn.ftc.gov/pls/dod/wsolcq$.startup?Z_ORG_CODE=PU01 to the FTC complaint form. I've told many people about it, so you may want to do the same. Make sure you give specific examples or even let them know you have documentation of deceptive or misleading information. Also, if possible, please scan & send copies of these documents to me at [DELETED]. I haven't given up, but it does take a while for the squeaky wheel to be heard.

As far as CIT, here is their main site: http://www.cit.com/main/default.htm . Also, within this site, I found e-mails and have sent copies of my rip-off report, including a copy of all the complaints listed under Lease Finance Group in the Rip-Off site. I did get the Rip-Off Report Do-It-Yourself Guide and it did have some good steps to follow. However, it was a little lacking in the cyberspace rip-offs. I've been paralleling the thoughts or ideas in this Guide to try to apply them to the internet. For example, instead of sending faxes, send e-mails. So every web site I am interested in, I look for e-mails and make up a group listing & start bombarding them with e-mails and include my rip-off report, plus any other rip-off concerns.
