Citibank forced a home equity loan on an 89 year old woman in New York.  The loan was forced on her February 2012.  Her Doctor diagnosed her with Dementia in 2010. I am in possession of this letter. Citibank promised a Release of Lien due to the error. The Release was promised by Citibank employee Miss Towell from Texas. The Release was promised May of 2013. The customer passed away March 22, 2013.

You still failed to explain your initial claim...How did they force your mom to take out a home equity loan.

You seem to be doing this by infering since Citibank was only 1/2 block from her house and she "wanders" that somehow constitutes "force".  So did she just wander into their branch one day and they locked her in a room until she signed?  Did they knock down her door and held her down until she signed the loan?  No..you do not know what happened because by your own admission you didn't even know about this loan until after she died.  This is an important piece.

You say that she was diagnosed in 2010. So why was she still driving in 2012?  Especially since you are saying that because of the diagnois she couldn't know what she was doing.  Who was handling her bills during this time?  Why didn't that person see this loan, and more importantly stop it or at least keep the money from being spent?  Or does her diagnosis only apply to this loan, but she was totally capible of mainting her daily life otherwise. 

As for the POA.  You got that 9 years before her diagnosis. So it was most likely only allowed you to make decisions on her behalf, but it would not have assigned you as trustee nor did it take away any of her rights.  

You do see the issue don't you? 

No I am not "attacking" you, no I am not "defending" the bank.  I get it. I understand how hard it is to deal with dimensia.  Where had you come here and said you were her appointed trusteee and she was declared incompetent to handle her affiars, and with that information the bank still refused to help..I would be right with you. But that is not what you did.  You've come here spouting out terms such as "forced" and "Elder Abuse" when you in fact don't know the intial situation, nor have you shown any of that.  

But let me toss out a couple of other things.  Remember you don't know anything about this loan.  What if there was elder abuse?  What if someone she knew/trusted talked her into taking the loan out?  What if your mom gave the money to that person?  You can't come here and say you know that didn't happen, because you have already shown you were not there when the loan was originated, and you don't know where the money went. Until you find that information out you can't exclude this possibility.

The bank has the original loan documents..right?  So on those documents it would tell you the account the money was transfered too.  If it was by check they could trace the check to find out where it was deposited.  From there you can access that account and see exactly what it was spent on.  If it was transfered to an account of another person...that should tell you all you neeed to know.   If it was more like a line of credit,  you can see the detail of the purchases she made.  2 1/2 years is more than enough time to get all of this information.  Now, yes after this amount of time they may charge you a research fee of a couple hundred dollars, but at least you would know.  Perhaps when you look at the loan documents you may get another surprise, perhaps it wasn't even your mom who took out the loan.  Perhaps she was a victim of Identity Theft, where you have a whole other set of issues to deal with.

By the way what has your lawyer said about all of this?

Anna had Dementia since 2010. Yes I her son did have Power of Attorney since 2001. Anna's hometown bank Citibank was less than 1/2 block from her home. Anna did wander alot, often ending up at the local school yard. Anna also had three documented car accidents in 2012; two were in one day. Fortunately, for all's safety, her license was taken away.  I do not know what happened to her money. For all we know, Anna might have given it away. Perhaps she buried it in her back yard. Her Doctor and I know Anna was not of sound mind at the time the loan was approved. Yes, there is alot more to the story. I have been dealing with Citibank to straighten this situation out.  Miss Towell , Citibank employee, of Texas did promise a Release of Lien due to urgent, catastrophic circumstances. I, her son, was not informed of the loan and only found out about it after her death in March of 2013.  I received a phone call at Anna's home about one late payment the day after she died. Citibank was informed of Anna's death. Citibank continued to call two more times, before Anna was buried. I wrote this report to protect consumers from Citibanks deception. They are a misleading, cold and calculating business. I have spoken to more than 40 employees in the last year and a half. This report was only written to protect others from situations like mine. I didn't realize that it would offend people. The facts are the facts. Perhaps you should check out other Citibank complaints; there are too many to mention that deal with Elder Abuse. I only hope others do not have to go through what my family has when dealing with Citibank.

Michael Corbat, Citibank CEO, in New York states that "Citibank has no one big glaring issue to fix; but a series of things they need to address across the workstream. He does not want Citibank's credibility jeopardized."

Just how did this bank force this woman to get a home equity loan?  Not only that but what happened to the money after she got it?  Did they force her to spend it as well?

Then we get to the letter from the doctor.  Okay, so you have a letter.  Do you have a Power of Attorney saying you are resonsible for her affairs?  Do you have an Order from the Court saying that she is incompetent to handle her affairs and they assigned you as her trustee?  Or are you trying to have it both ways, where you didn't want to have her declared incapable but then you also don't want her responsible for anything she did?

Yea I bet the full story is much more interesting.

How did they "force" this on this woman??? Did they hold a gun to her head?? Where was her POA/RP during this time?? And what does a letter have to do with it??? IF you were her guardian then what is the reason you did not stop her?? There is alot missing from this report.
