I was charged for two plasma TV's, two TV brackets and two TV cables by an online merchant called Value Plasma. I never received one of the TV's nor did I receive the credit I was promised by the merchant. The merchant substituted a refurbished TV for the new TV I did receive. I sent in 30 pages of documentation showing the weights of the merchandise and information on the refurbished TV switch. I sent the merchants web page showing the TV as "Brand New" and I sent a picture and copy of the serial number which Sharp told me had been refurbished months prior. The warranty for the TV had even been removed from the manual.
I received only one cable and it was a cheap cable. The cables were supposed to be a "level 5" cable which I have since found out do not exist.
The merchant has a long history of deceptive practices including an unsatisfactory rating from better business for same. I sent that information to Discover Card along with many other testimonials from consumers that got ripped off by this crook.
The merchants defense was to send in tracking notices for the refurbished TV and brackets that were sent. A child could see that the weights on the shipping confirmations did not add up to the weights of the Two Tv's and brackets. I sent Discover documentation on the weights of the Tv's. At the very least they should have been able to that figure out
Twice Discover Card led me to believe the matter was taken care of they issued a credit to my account only to reverse the credit months later. Now I have paid $3,500 and only have a refurbished TV and 2 brackets and they now tell me the matter is closed. The merchant is still in business using Discover Card to rip people off online. Discover did not to stop the fraud of this long established crooked merchant. All I got from discover as an explanation for the reversal was a hand scribbled note from the merchant saying all merchandise had been sent and the tracking notices which did not add up to the weight of even the TV's let alone the brackets and cables.

Thanks Robert finally someone with some sense. That is actually what I have planned to do. I have told Discover if they do not cooperate I will supeona information and yes they will be a co-defendant for allowing this to go on. They don't seem to care who they give their card to as long as they bring in money for them. I had another issue with Tiger Direct and their rebate scam. I advised Discover that they sent me bad rebate checks. They said well you authorized the charge, too bad basically.
I was watching the history channel the other day, a man had gotten 2 years for stealing tools, now instead of getting time crooks get credit cards.

You could file a criminal complaint against the Plasma company as well as a civil suit against them. Doing this will open the door to obtain information on the company via two routes.
Route 1. As part of a criminal investigation, Discover will be required to provide the information to law enforcement who is conducting a legitimate criminal investigation (fraud).
Route 2. Once you file a lawsuit against the Plasma company, you can request that the court subpeonea the correct information from Discover Card. Discover must comply with a court ordered subpeonea for the information. Then your lawsuit against the Plasma company may proceed. (if necessary, you can list Discover Card as a co-defendant since they refuse to provide the information.)

Actually read and understand what I wrote before filing a rebuttal. One TV was never shipped and I can prove it from the Fedex tracking information because the missing TV has a weight of 50 pounds and Fedex weighs all boxes. The other TV appeared to be the new TV I ordered, it was packaged in a sharp box with the model number on the box. We only discovered it was reburbished when we called in the serial number to Sharp, we were tipped off because the serial number in the manual did not match that on the TV, there is no way we could have seen that on delivery.
I have filed with better business against both Discover Card and the Merchant. Add my complaint to the many unresolved complaints for Value Plasma which has an unsatisfactory rating for deceptive advertising. I have also filed a complaint with the NY states attorneys office because the merchant provided fraudulent information to Discover Card when they sent information saying 2 TV's were shipped when only 1 was. Discover Card cannot charge me for merchandise I did not sign for. On the reburb that we did sign for I advised Discover Card that it was not the new TV I paid for. They originally sent a letter advisng the merchant to pickup the reburbished TV and to issue a credit for the TV not received. The merchant responded in writing with false information which is mail fraud.
Discover Card pretended to investigate, they did not, they jusy read the fraudulent info from the merchant even though I had the proof that one Tv was never shipped or signed for. The Dscover card employee who made the decision told me he thought there were two TV's in one box. I had sent the weights of the TV's and they had the Fedex tracking weights, I also sent a picture of the box with one model number on it. These were both large Plasma TV's they are individually boxed. They screwed up plain and simple. I want to take the merchant to court but the address they provide to consumers is a false address so I will have avproblem serving the merchant, so far Discover Card will not release the information I need to serve the merchant a court supeona.
Value Plasma has committed mail fraud, has a false address and an unsatisfactory rating with better business and I have sent proof of all of this to Discover and they still find this merchant to be worthy of their credit card. I also told Discover card that the serial number on the TV did not match that in the manual and I suspected the merchandise was stolen. It is illegal for anyone to accept suspected stolen merchandise. I am not the first to have this problem with Discover Card and this Merchant according to consumer reviews however one scammmed customer reported that Citi Bank took care of a similair problem they had. I am switching to Citi Bank.
After getting the run around from a number of Discover Card employees I was finally given an address to write to at Discover which is supposed to be a resolution center, I will continue to post this story and to report how that is handled. This is a large scale scam, this merchant appears to be operating under numerous names, all with Discover Card Credit. This would make a good class action case. I also plan to contact the media if this is not resolved. I will not pay for something I did not receive.

I have a VISA Platinum which through VISA has a very good buyer protection plan and purchase warranties which would have helped in a situation such as this. The buyer protection plan covers such things as defective products and merchants who send the WRONG product and won't accept a return of the wrong product and issue a credit.
Discover may not offer such buyer protection plans but other credit card companies do.

I have a VISA Platinum which through VISA has a very good buyer protection plan and purchase warranties which would have helped in a situation such as this. The buyer protection plan covers such things as defective products and merchants who send the WRONG product and won't accept a return of the wrong product and issue a credit.

Discover Card is not at fault with this information. Discover Card is the card that you used to pay for it. They do not provide warrenties or anything else for that matter. You should be writing about the company that ripped you off. This is not a fraud investigation on Discover Cards side. You signed for the merchandise. You should have just sent it back without signing for it if you saw it was a different product. NO CREDIT CARD COMPANY WOULD HAVE REFUNDED YOU $3500 for a merchants mistake. I would be contacting the BBB and writing a rip off report about the merchant.
