An update on my issues with FCC...

Called their Consumer Affairs Division 904-722-7691. A Daphne Amerson answered the phone. I explained I worked for the mortgage company where I did my loan, and that there was no prepay on my loan. I gave her my loan number, and LO AND BEHOLD, she said she was looking at a prepay rider I supposedly signed! I said, no you aren't. She said, I have it IN MY HANDS.

Okay, get real. Of all the thousands of files, she happened to have MINE sitting right there under her desk?! COME ON! I told her I wrote my own loan, through my employee loan department. FAX ME THE RIDER.

Asked about the $110 `Broker Opinion Fee' on the demand sent to me. Was told my house had been inspected. I asked by whom. Couldn't say. When? Didn't know. Informed her DRE doesn't allow bogus fees. She got off the phone!

Have not heard from them since. I get voice mail, and no return call.

My Corp execs have recieved apologies, but STILL NO ACTION!

January 27th.

My own secondary marketing execs (I work for a major mortgage lender) have contacted THEIR contacts within Fairbanks, and have recieved profuse apologies for not running a payoff Fairbanks recieved ON DECEMBER 26TH!!!!!

Yet, I contact Fairbanks, and lo and behold, no payoff has been run, and each CSR I talk to says there is no notation in the file, and all they want to know is "When are you going to make your January payment?"

I owe them NOTHING! They were paid off, in full, A MONTH AGO, AND they are now adding LATE FEES!

Get this, there is NO GOVERNMENT REGULATION IN UTAH THAT SAYS PAYMENT MUST BE RUN THE DAY RECIEVED! A corrupt servicing company like Fairbanks can legally hold payments until other fees can be applied. I have been in the business for 25 years, and would NEVER have dreamed a comapny like this could operate and get away with it. Something I want all of you know, every legitimate mortgage company I know in this industry WANTS to help it's customer. They will bend over backward to help you. They WANT you to stay their customer. Fairbanks is NOT one of them. As I see it, this company sees equity, and goes after it, even if, like myself, you have never missed a payment and even paid early.

As of today, I have a few names of the people my own company has talked to. Each one has told my corp execs that the "payoff was signed off, and was run," but it hasn't been. Today, I recieved a return call that they would "Look into it."

Worst part is, I have become so distraught at the situation and Fairbanks' blatant disregard for my own companys' attempts to get them to solve the problem, I can no longer do my job, and am ready to quit. I have lost faith in the process my own corp is using to help me, because it has gone nowhere.

I am already making payments on my new refi lender, but I may lose my home to Fairbanks because I refuse to pay them money they are not due. Every bit of evidence and records I have (and I keep EVERYTHING, I'm in the biz, remember...) is being turned over to Daniel Mulligan attorney, at 660 Market Street 3rd Floor, SF, Ca. He has filed a class action against Fairbanks on behalf of three plaintiffs.
