I left a small local processor to work for first american. At first everything was going well and I had tremendous support from my contact at the company. I had set up several accounts and equipment leases and was making alittle money, then some unforeseen circumstances arouse in my personal family life. I ended up leaving the company but was still receiving residual checks for the account I had set up.
Due to personal reasons I screwed up one account and never delivered the equipment to the merchant which I had been payed to do. This was completely my fault and the account was cancelled and I had to repay approximately $1700. I expected this and took full responsibility and they keep my residual checks for a few months to repay the debt. This is when the underhanded outright theft and deception occurred.
I had planned to have the residual payment begin again in October or November and very much needed these funds as I had become physically disabled. Instead of a chewck, I received a letter stating that they had paid a prior lease off to a different company for another of my merchants. In the contract I signed with them it stated that I could not be held fiscally responsible for a lease that goes bad after the first lease payment was made by the merchant. So they went anothewr route to please a merchant that had intended to leave the processong company and made a deal with her to pay off old equipment to keep her from leaving. This was never discussed with me nor did I ever agree to this transaction that had nothing to do with me.
First American then went on to charge me nearly $1500 for something I had never been involved with. I called the company and received an email from Don Sissock stating that when my debt was payed I would once again start receiving resiual checks. I stated to him that I wanted the money owed to me and that I could not be held responsible for a deal made on my behalf without my knowledge or approval of such deal. Never heard back for this eecutive with the company.
I continued to call and email then some other guy calls me and admits he doesnt know what has happenned but he would find out. He later tells me that someone noted on the merchant account that I had agreed to this deal. I asked who noted this and told him I wanted to see written or recorded proof of my approval but was given nothing. I called a few weeks later again demanding proof and was told that it existed but he could not provide it to me because it was "locked away on their computer system and could not be forwarded'.
This guy told me last week that I should start receiving residual checks after next month but this is also a problem. So far this year they have kept residual checks in the amounts of $457.10, $441.91,$488.68 and $566.42 for a total of $1954.11 plus november and december of last year to pay a amke beleive debt of approx $1500. Sound pretty honest to me!!!!!
