We have had Geico Insurance for over ten years now and what has happened to us has blown our minds. We have never made any claims on our insurance until recently. Here's what happened. Me and my husband were driving to the hospital late at night, My husband is 68 years old and has breathing problems. When we were making a turn at a stop light and some young juveniles pulled out a gun and shot the side of our car. There were many bullet holes and two other cars behind us were also shot. One person in the last car was killed. We called 911 and my husband was rushed to the emergency room. I got out of the car and stood with the other victims on the side walk while we waited for the police to arrive and was horrified about the person who died, It was tragic. We were there till morning time, All night we stood and waited for the police to do their work. Thankfully the criminals were arrested within hours. The next day we called our insurance company to make a claim to have our Cadillac fixed. Only a few days went by and a Geico representative came to our house and took some pictures of our car. A few more days passed by and we received a phone call from them telling us to get a quote on the damages. So we did and had the papers faxed to their office. So far everything was going good until this. Two weeks later we received a letter in the mail telling us we had to take a trip to visit a investigator/Attorney who works for Geico. It was at least 50 miles away but the letter told us we had to or they will cancel our policy. So of course we did. When we got their we met up with their agent who ask us to give him a recorded statement of our story. After we were done giving the statement he told us that the criminals also had Geico insurance and that the reason we had to give a statement was to make sure that we didn't know the criminals and that this was not a scam and because their was a death involved. It sounded reasonable. He told us to sign a release document that will not allow us to make a claim for emotional distress. I asked him if it would interfere with the claim on our vehicle damages. He told us it only had to do with emotional distress. Well we read and signed it, It didn't say anything other than what he described. Then we went home. Two weeks later I had my daughter check the status on our claim and it was closed. I was wondering to my self why we haven't received our check for damages. So I called Geico. They told us that the reason the case was closed was because we signed a release form that basically gave Geico permission not to pay for damages. I told them what the investigators/Attorneys said about that document and told them their was nothing mentioned about damages on the document form. The claims adjuster apologized and told me their was nothing she could do. I asked for a copy of the document and a copy of the recording for proof that he verbally lied to us. She said she will be happy to send them to me. We are stuck with over $4,000 in damages. Does anyone have any advice on this? Please help. Thank you!

It's been two days since I wrote my report and I have an update. My claims adjuster called me back with info on the tracking # for the recorded statement that I requested. I told her I was on my way to see my lawyer and she told me to hold off while she made a quick "Review" of my case. I waited 3 hours and she called me back and was excited to tell me that their had been a "small mistake" on our records and that she will immediately send out our check for damages and that I will be receiving it in 7-10 days. So I called my lawyer and put him on stand by until I have the check in my hand. After we have our money we will be changing to a new insurance company. Geico has proven to us that they have tried to screw us over after being customers for ten years. What a sick company. Every time I see that commercial on tv from now on I'll probably flick it off. I'm 65 years old and hen you hear something like that coming from an old coot like me then you know they got to much up their sleeve.

This is what I'm talking about all the time.  People nowadays are just too stupid to live.

In any accident, injury, etc. the VERY FIRST thing you do is get a lawyer without saying a word to anyone else. Let your lawyer do your talking for you.

This is just basic common sense.

You asked for advice.  Here it is:

Hire a lawyer.  If you can afford a Cadillac you can afford to get legal advice.

Your insurer figured out you were not too bright when you agreed to drive fifty miles to their office to meet with their representative, who may or may not be an attorney, and you showed up and signed legal papers without advise of counsel.

If you have comprehensive coverage, the damages to your car should be paid by your insurer regardless of who insures the person who caused it.
