My web designer used ONE of Getty's pictures. Unbeknownst to me, it was trademarked. She said there wasn't a watermark and did not have an indication that it belonged to anyone because she got it on a FREE image site. We did not receive a cease and desist letter. Obviously we removed it immediately.
Their "fine" was $1800. I did some research and learned what a monumental extortion company it is. Many people with the same problem said they ignored the letters and they stopped. I decided to let it go. That was 2 years ago. I just received a letter from their attorney's office saying they are suing. I had to hire an attorney of my own who was able to settle for $1000. (We are a very small complany) I delved further into Getty's and the law offices that have taken them on as a client. It seems that they have found every loophole and sealed it up TIGHT!
When will SOMEONE put together a class action suit?? If nothing else- for harrassment! I have read that many people have filed complaints with the Attorney General's office in Seattle and there is a petition going around online. At some point something has to be done to stop them. I hope my report here can help. I figured that any type of documentation is one step closer to shutting down these practices.

Self Righteous Stupidity

To the report responder that implied that someone using something marked as free is a federal law breaker and assuming a self-righteous stand on this subject. I ask this question: If when perusing a store and you come across a stand marked ‘Free’ would you feel comfortable taking the ‘Free’ item? Or would you demand from the store owner evidence that the manufacturer agrees with his giving away the item, and documentation of this before you take the ‘Free’ item? Kind of a stupid question isn’t it…
I am amidst a Getty scam as we speak and the only thing I am guilty of is helping out a friend by allowing him to make a website for me. He needed money so I gave him 200. to get it started. Next thing I know I’m getting demands for 1,200. for a picture of a hand shake? The website was not even completed, he just posted what he had done so far so that I could have a look. The picture came on a template that no doubt Getty happily handed over as part of their scam to get pictures they could threaten to sue over into the public.
It is easy to point fingers at innocent folks who are honest and would never knowingly take something without paying for it if it had a cost attached.
Here is another question for you: If the middle man who sells the items marked ‘Free’ takes note of each person who removes an item from the store stand and then claims they shoplifted trying to press charges against them, would that seem like a bit of a scam? Sorry, I know it is another stupid question…
No doubt you answered that it is a scam. And by the middle man not stopping the store owner, or posting clear notices the best he can at the door entrance it is certainly a scam he wants to keep going.
I would be happy to contribute to a class action lawsuit against Getty Images and the bottom dweller attorneys they have employed. As far as Getty ‘the middle man’ goes, nice try.
I am currently trying to find any suite against Getty Images that I can support.

None of those things have anything to do with copyright. A web designer that uses images of unknown origin on a commercial website should really find another line of work. Here's a tip. If it doesn't beong to you, it very likely belongs to someone else.
Not sure what you think merits a suit. Since you did use their image without permission, what is your cause of action? Being pissed because you got caught doesn"t really advance your cause.
