If you own the website, it's your responsibility. If the 3rd party broke copyright law, again, they will go after the owner of the site, not whomever developed it. How are they supposed to know who developed the site?

You need to see an attorney, and yes, you will probably have to go after your developer, but that is an issue between you and them, not between Getty and them.
