Loan with Homecomings originated 08/01/2003 for pay-off of previous mortgage holder; RBMG., Inc. Payments are current.
On 1/14/06 we received from NetBank a letter with a Recorded Satisfaction/Release of Lien from the County Register of Deeds stating the loan was paid in full and the lien released on DECEMBER 30, 2005!!! WE WERE NEVER ADVISED OF SUCH LIEN, NOR RECEIVED ANY NOTIFICATION FROM RBMG., INC. OR HOMECOMINGS THAT THE MORTGAGE WASN'T SATISFIED.
I tried contacting NetBank at 1-800-933-2890 & 1-800-462-8000 and after numerous attempts was unable to get through as lines were always busy.
On 1/14/06 I sent an e-mail complaint to Homecomings at their website address expressing our disgust and asking for clarification as to why it took them nearly 2 1/2 years to pay-off the mortgage to RBMG., Inc. and a remedy for the damage it had done to our credit. I gave them until 1/20/06 to respond by e-mail or phone. THEY STILL HAVE NOT CONTACTED US.
On 1/30/06 we received an amended insurance premium bill from our agent informing us that our car insurance premium had been reduced by $431.00 for the 6 month policy term. On 1/31/06 my husband called the insurance agent was was informed that the reduction was due to the fact that we NOW HAVE PERFECT CREDIT due to the outstanding lien being released!
This means that we have been overcharged in excess of $2,000.00 by our insurance company due to this UNKNOWN LIEN, and an amended Homeowners policy is forthcoming as well, with a new lower rate due to the same scenario.
We have been repeatedly turned down on credit applications and refinances and assumed it was because of our debt ratio possibly being too high; however, WE WERE STUPID AND DID NOT TAKE THE TIME TO CHECK OUR CREDIT REPORT...we had no reason to suspect that there was a problem.
Our recourse now is to contact an attorney for a lawsuit to collect monies owed to us from the insurance companies, to rectify our credit report, to remove the wrongfully filed lien and to reinstate our good names. We will also file a formal complaint with the Better Business Bureau in Texas, against Homecomings/GMAC & NetBank, whoever the hell NetBank is.
