May 16th, 2016, I purchased a vehicle, put $700.00 down, went on deferred payments for $400.00 each on 5/20, 6/3, 6/17 and 7/1/2016. I made a payment of $200.00 on 5/19/2016 to cover the gap insurance for 2 months.  Acct. # 6819409. I made the first 2 payments on time, I found out my sales dropped at work and called them to let them know my payment would be late, they said make as soon as you can, we can pick up the car because you have no grace period, I said OK. I had also asked about my tags, they said they did not have them yet. I sent an e-mail mid June and called a few times asking about my tags and to keep in touch with them about when my next payment would be made.

In the interim, I received a call from Mr. Williams who told me that I was set for recovery and they saw where my payments was made on 6/29/2016, I had a payment due on 7/1/2016 and that payment needed to be made immediately and they had my permanent tags to my vehicle. The dealer tags expired 6/30/2016. So I called them and let them know I would make the last $400.00 payment as soon as I could, advising them again that my pay had decreased, I asked for my permanent tags and then was told they did not have them. I also informed them since they accepted the payment for the vehicle almost two weeks late they breached the contract and accepted the modified terms, I was then told to make the payment as soon as I can. On 6/30/2016, the dealer tags expired, I sent e-mails and made calls about my permanent tags, I was told the message was left with CNAC and no one ever got back to me. I called DMV and they told me I could not drive the vehicle because I would be driving illegally and to get the tags from the dealer. I had to park the car on 6/30/2016.

On 7/14/2016, I made the last payment of $400.00 and called them to let them know I had made the payment and told them I had not been driving the car and to please send me my tags, they then said they did not have them, I informed them Mr. Williams told me last month the tags were there at the dealership and they were holding them because the payment was late, they denied any acknowledgement of this. My first regular payment was due 7/15/2016, I advised the dealer I would pay it on 7/22/2016 and then I would be back on track, because you have accepted the last 2 deferred down payments late this should not be a problem, he then said "Oh, you finished paying off your downpayment"? I said yes..he said the down payment is not refundable and IIf I don't get the regular car payment by tomorrow by 7;00pm, I will have your vehicle picked up. I told him them why did you accept the other 2 payments late and not just pick the vehicle up then? That is $800.00 that you are saying I threw away and I could not drive the vehicle? He said it was in your contract that the down payment is not refundable. I told him that was not right, you should have picked up the vehicle on 6/18/2016 when that payment was missed instead of accepting 2 payments after that, which were both late but now you are saying you will pick up my vehicle because this payment is late? I told him the vehicle had been parked because I was not able to drive it due to expired tags, he said oh well that's not our fault.

They picked up the vehicle on 7/17/2016, I was on my way to get my stuff out of the vehicle and decided to call first and was told that I had to make an appt to get my belongings, so I did. I made the appt. for 7/25/2016, when I got there the vehicle would not crank, I told him probably because it sat for a few weeks, he could not drive it out to me so I could physically get my stuff, I had to rely on him getting my stuff, he said I was not allowed in the bay area. Once I received my stuff, he wanted me to sign a disclaimer that I would not retaliate against their company for the way the sale was handled, I refused to sign it and he said well, I will put a repo on your credit report then. The tag area had a open sign, no one there, they said oh well. The tag/title area had a sign on it saying open M-F, 9 to 3 and I asked if I can go ahead and get the tag that was sent to you for my vehicle, no one was back there and they told me the lady comes in when she wants to and they do not know where she keeps he stuff at. They said we will mail it to you or maybe DMV mailed it to you. I never received the tag for the vehicle.

JD touts themselves as a business wanting to help people with credit issues however this appears to be a fasade to just rip off vulnerable people. This business, supposably prides itself on helping people with credit issues but it is only interested in robbing from the already downtrodden. They should not be allowed to continue to do business, they amount to loan sharking (but for a car and not money) If I loaned you $1,000 dollars and told you I understood you had mony issues and you had trouble paying me back, whos fault is it? Then If I told you you have to pay me back the $1,000 plus another $1,000 and all at 25% interest, who is the crook here? I would go to prison. Why is this company allowed to do this? It is the govt. responsibility to prevent its citizens from being victimized, either thru criminal activity or other means.

Why would you buy a car if you don't have the down payment?

You seem to be totally confused about how to purchase a vehicle.  There is no reason to even begin the purchase process without having the down payment in hand.  Deferring down payments means you can't afford it. 

Going to a subprime lender shows you didn't do your research.

Making 3 out of the first 5 payments late is inexcusable. 

No, I don't work for this dealership - or any other dealer. I am just a consumer that has purchased vehicles over decades and never have even heard of a "deferred down payment".  Study and learn what you need to do before you run out and sign a contract for something you can't afford.

 I never asked to be a victim. They should have picked up the car instead of giving me false hope. Being a sales person it happens where sales lack just as a car sales person. I'm not rich enough to have extra money laying around...

A verbal agreement or an assumption cannot modify a written contract. A written amendment is required to modify a written contract.

Three of your first five payments were late combined with the intention of yet another late payment. You (not the lender) breached the agreement; therefore, you do not have a valid complaint.

Oh the logic of a deadbeat borrower...

You have perhaps given us the biggest "entitlement" attitude any sub-prime borrower has ever given on this site...and that is saying a lot.  This statement is perhaps the biggest entitlement of all time.

My first regular payment was due 7/15/2016, I advised the dealer I would pay it on 7/22/2016 and then I would be back on track, because you have accepted the last 2 deferred down payments late this should not be a problem,

Really...out of 5 payments you made 3 of them late, and seem to think that this is okay because heck they accepted the first two so they should automatically accept every other payment late because you say so...right?

But you don't stop the blame game there...you actually blame them for NOT picking up the car after your first missed payment.  Wow....if this is really your attitude you are beyond any logical help.

So let me just say that the only person who set this up for failure was YOU.  You signed a contract that stated you would make payments on given dates, YOU failed to meet your legal obligations.  There was NOTHING in the contract that said you could change it at will.

So now as a Repo you WILL be on the hook for any deficency balance.  You will have debt collectors calling.  You will be sued if you fail to pay them.  And the judge will NOT care about your story about how they should have picked up the car after your first missed payment.

Good luck in your sub-prime life...
