 My wife was hit in the car that we bought from JD Byrider in June of 2016 and she was hit on Thursday December 22nd and we had the car towed to JD Byrider and ask them what they give us a loaner vehicle and they refuse to do that and yet we still have to pay the insurance on the car plus the monthly payment bi-weekly payment and yet once again they refused to give us a loner while the car is being repaired and it was not my wife's fault somebody hit her that did not have any insurance driver's license and failed to yield the right away and I told JD Byrider and they still refuse to give us a loaner vehicle and we're down to one vehicle right now and I'm paying a lot of money for that car it is a 2006 300 and which truly was overpaid for this car way above what the car is actually worth so what could we do to get out of JD Byrider does this is truly a rip-off.]

You spent less on insurance but still expect the benefits

Some auto dealers or service centers may offer a loaner vehicle but not offering one is in no way a rip-off unless the provision of a loaner vehicle is a component of the sales or service agreement. Is the provision of a loaner vehicle a component of your sales or service agreement?

Apparently you declined uninsured motorist coverage or you have no rental agreement on your insurance policy. As a result you spent less on insurance but for some reason you still expect the benefits. You lost that gamble. That decision is not the fault of the dealer.

Your dissatisfaction with the cost of the vehicle is a case of buyer’s remorse and is not a factor.

Why should they??? It's not their mresponsibility to provide a loaner to you. You should have gotten a rider on your insurance that provided a loaner/rental for you in a case like this. There's no car dealership I know of that would give you a loaner just because you bought the car from them.

 How is this situation in ANY WAY thier fault?? THEY were NOT the driver that hit YOU. THEY are repairing your vehicle. THEY may not have a loaner to give YOU and YOU obviously DO NOT have the insurance to cover it. YOU cannot expect that the repair shop is going to give YOU a loaner when THEY ARE NOT LEGALLY SUPPOSED TO!!

Misdirected

First off I am sorry that your wife got hit and glad that she appears okay.  But JD Byrder or ANY car dealer or company isn't responsible or required to give you a loaner car regardless of the reason.  And yes, you are still required to continue your payments and keep up the insrance even if you can't drive it.   In fact even if your car was flatend by a herd of elephants, you would still owe the balance of the loan. 

As for the price you paid.  I am sorry to say but that is a direct result of your past credit history.  They are a HIGH RISK dealer for people that have not proven they can handle credit..again reason DOES NOT matter.  As a result HIGH RISK equals HIGHER cost and HIGHER interest rates. 

The person you need to be upset at is the person that hit your wife.  If they are at fault, the are the ones solely and 100% liable for all of your damages.  Them having no insurance makes things tougher but it doesn't take away their fault.  In fact in many jurisdictions a person with no license or insurance who causes damages could actually be arrested for a felony crime. 

Depending on how much your expenses are, you may be able to deal with this in Small Claims court without an attorney by going after the person.  Now, getting the money if you prevail is another matter, but if they have any funds at all there are things you can do to take them.

FYI, this is a good reason why you need to make sure you also have unisured motorist insurnance and rental car coverage.

Insurance Matter

It is the insurance company's responsibility to supply a "loaner" or rental unit...PROVIDED...you agreed to purchase that coverage as part of your insurance contract!  Secondly, you would do very well to go back to second or third grade, attend the classes and stay awake during said classes to learn sentence structure, punctuation and grammar.
