I have had a problem with a company called {Just Energy} coming to my door for several years.

I have complained to them dozens of times and have 17 letters from them saying it will not happen again,

yet it happened again 2 weeks ago. I am tired of it and am taking these letters along with video showing them on my property to small claims court.

It only costs $20 and I am suing for the full $5000. I think I will win with all the evidence I have including police reports

you seem to know how just energy works. you sound like maybe one of these so called independent contractors from just energy. with the amount of knowledge you have about law you must know that companies are responsible for independent contractors and would be in this case. considering you probably make your living working for them then you must know that when they come to the door they are wearing just energy clothing and claim to be working for just energy. maybe fraud is another legal theory to consider but you would already know that considering your extensive legal background.

The specific laws are tresspassing, stopping the enjoyment of my property,harrassment. the only reason I am not asking for more than $5000 is because that is the limit in ny state small claims court. what law school did you attend genius

You can't just randomly walk into court and ask for $5,000..you MUST have the law behind you.  So what SPECIFIC law are you claiming they are broken where the remedy is a fine you can sue them for in Civil court?

By the way I suspect that these solicitors who are coming to your door are considered "Independent Contractors" in that they are actually not employees of this company.  If that is the case, you may have to go after these people individually but it would have to be that same person coming back again and again.

If they are violating Tresspassing Warrants, then that is a criminal matter that you need to contact the police and have them arrested.

If you don't have a specific law.  You also have to worry about something known as "Vexatious Litigation" as well as "Frivolus Lawsuits" both are basically cases where a plantiff files suits with absolutly NO legal merrit.  At best, your suit would be thrown out and you would be required to show proof of it's merrit before you can file one again.  At worst it becomes a criminal matter and you could be arrested. 

But of course you already consulted an attorney on all of this..and they told you that you have a slam dunk case and will easily walk away with the $5000...right?
