I have been receiving phone calls from this company and just received in the mail a letter stating I owed money to a company I have never heard of before. I have just done my FREE annual credit report (YOU need to do this to) and there is nothing on it regarding this company. I have blocked each new number that this company has called me with and also sent the letter to the shredder. I have NEVER returned a call to this company nor responded if it's NOT on my credit report I'm not worried about it. I DO NOT understand why anyone else would. If you know your credit report and also the statues of limitations from your state (LOOK that up) it's ridiculous to even respond to this company or any others like it. Get with the program people..

P.S. When I looked up the company online it was an ERROR.. hopefully there has been enough complaints about them to put them out of business???

If you have received a letter from Merchants stating you owe a debt that is not yours, ignoring it may not be the best solution. If you look at the bottom of the letter, there is a caption which reads you have 30 days to respond to this attempt to collect a debt (or something to that effect). If you do not respond to the letter, they will claim that it is a valid debt (they know its not but this is Merchants we're discussing here)and they may do 1 or 2 things.

1. Report it as a collection account; and
2. Sue you to collect the debt.

Understand that Merchants does not care that the SOL on collecting or that the time for reporting it legally on your credit report has passed. They will do it.

I received a letter from them on the 12th of May, 2006, (I responded with the SOL and cease and desist letter) checked my credit report and there were no alerts. On the 27th of May, 2006, there it was a collection account which had been placed on my file.

The account they are trying to collect was charged off more than 8 years ago. The SOL in my state is 3 years after the date of last activity (10/2000) the SOL for reporting to credit bureau was 10/2004.

I understand that there are bottom feeders like Merchants all over and I understand that to do nothing is not the answer.
