National Credit Acceptance Company has sued and gotten a judgement on my wife for a debt I believe has been written off. Sacramento California

Just wanted to report that this company has gone to court in Licking County Ohio and gotten a judgement without here ( or my ) knowledge. They also have gotten an order to garnish our checking account. We knew none of this until we got an order from the court and then a notice from our bank that they had been ordered to send funds to this company. We got less than one weeks notice. My wife is filing an appeal, but this has to be one unethical company to do something like this. I see many other postings regarding this Alan Laskin and the other two attornies involved in this. Is it not illegal to have a dept written off, then try to collect it for the full amount?

In a word: NO. It's perfectly legal. A debt that has been charged off (or written off) has NOT been forgiven and may be collected; even sued for in civil court.

There are plenty of ROR rebuttals were I've tried to explain this for folks- you can search here and find them if you're interested.

The charge off is for accounting and business tax purposes ONLY - it's so companies don't report debts they have no intention or expectation of collecting as an asset under receivables.

Now, if your wife were to receive a 1099 for imputed income - then the debt has been forgiven.
