We bought our home in 2000 for the price of $16,000. In 2002, we needed a new roof, furnace and carpeting, so we refinanced. The company had their appraisers say that our home was worth $60,000, when in actuality it was only worth $18,000, so that we could borrow $50,000. Our loan was sold to Ocwen in 2002. They have aggressively pursued taking our home for the past few years.
They created an escrow account in our name out of the blue with a negative balance of $1042.00. When my husband called and questioned it, they said that it wasn't in their computer, but the letter was on their letterhead. And on their website, our escrow was listed negatively. We have been on a forbearance plan for our loan for two years. They told us that when we signed up for the forbearance, it would last about six months.
We went through a company named Foreclosure Solutions to try to save our home. They made us save money for about six months to give to Ocwen in a lump sum. They accepted the payment, but it put our loan six months behind. I have been asking how to get out of forbearance, but have been given the runaround. Their call center is located in India and when you call, the person on the phone becomes irate when you can't understand them, so I have taken to emailing them instead.
Every six months, our payment has went up dramatically. Our house payment started at $252 and is now up to $560 in a matter of four years. In January 2007, I made a payment through my online banking with Bank of America. I made a payment of $482, then the next day I sent an additional $30. The $30 was returned to me, saying that it didn't bring my loan current. My payment at the time was $520 per month.
On Feb 23, a sheriff arrived at my door handing me a sheriff sale notice. I called Ocwen and was told that they put my loan into foreclosure on Jan 25, without even telling me. I didn't receive a certified letter or even a phone call. I spoke with a representative, who told me to go ahead and send my payment and fill out financial information and fax it. I did it that night.
The next day I spoke with a rep named Scott, who told me that my payment wouldn't be accepted, even though they received it that day. (It took them a week to return it, only after Bank of America pursued them for me). He went over my financial information and told me that I could afford much more than what I was currently paying and asked me what I was doing with my money every month. This upset me very much.
I am a stay at home mom of two very young children, and my husband works very hard for what we have. I honestly don't know where to turn now. Our home is scheduled for a sheriff sale on May 10. I have filed a complaint with the Attorney Generals office.
If anyone knows of a lawyer pursuing a case against Ocwen, please let me know. I want to be involved as much as possible. I want to stop them from doing this to other families.

Do you people honestly only read reports like these to criticize? Do you have nothing better to do? Why are you even reading them if you aren't a customer of Ocwen? Or an employee? Do you just sit around all day and look up complaints? Honestly. And it is not because I can't afford it, pay attention when you read things. I can afford it, I refuse to fall into their traps of forbearance, then foreclosure, then forbearance again. If you have nothing positive to say, keep it to yourself. I am looking for people that are HELPFUL with my situation, not criticizing me when I am already in a bad situation. I didn't list my rip off report for that, if I wanted criticism, I would call Ocwen.

Britney wasn't rude in her questioning of you. She even stated something to the effect of "I'm not trying to bring you down" and "I hope you don't lose your home."
While I agree that they seem to be very unforgiving, the fact remians that you borrowed more than you could afford (young, old, midlle-aged, whatever) and now you can't pay. Any lender is going to come after you and if you can't pay up, they will take your house, no matter how many children you have.
If every lender made exceptions for people with children, or who didn't have furnaces, or who is a stay-at-home mom, there wouldn't be any financial lenders; they would be out of business. Then most of us would never be able to buy a home at all.
I don't doubt that they are unsympathetic, collection-crazy and the reps sound incompetent ("not in OUR computer", or becoming irate when you don't understand a foreign accent). I understand that it is a bad situation and I do feel for you.
However, I believe people need to be held accountable for what they choose to do fiancially, whether it be raising children, buying homes, etc. If you are not financially ready to do these things, you are certainly free to do them anyway but consequences will follow.

First of all, I didn't have a choice at the time. I had no furnace in my home and a baby on the way. Second of all, I was young and not very smart when it comes to mortgages. Third of all, I didn't refinance after I was in forbearance. I refinanced in 2002. Fourth, I didn't have the entire amount in Jan, so I had to send more the next day. I thought that they would accept it since it was only a day later. And why are you being rude to the person losing the home? Do you work for Ocwen or something?

Hi,
I'm not trying to bring you down, but I did have some questions regarding your post:
1. Why did you sign papers to borrow way more than your home was worth?
2. Why did you send a partial mortgage payment and then send out a $30 payment the next day??
Finally,
3. How were you able to refinance even though you were on a forebearance plan for the previous 2 years?
I truly hope you and your family can keep your home. I'm also sure Ocwen has been 'up to something' for quite awhile. Those are just some questions I had. Good Luck!!!
