In June 2013, our mother passed away of an aggressive form of cancer.  It was so unexpected, but she carried a life insurance that paid off her house, just in case.  We contacted Ocwen and was given the run around immediately, however I stuck it in.  I eventually received a young lady that processed my request for a pay-off quote, however the email did not come through, so I called back to get a re-request.  After days of getting the run around again, I finally received a gentleman that gave me the pay-off quote over the phone.  Thereafter, I sent the pay off to Ocwen by certified mail along with a letter and they accpeted it.  However, when I called to retreive the title, they rejected the offer and said they applied a portion to the monthly bill and took the rest and put towards the principle.  I asked where did the additional amount come from and they said it was fees that was applied, but they will send a letter explaining - which I never received.  I then asked who authorized this and they said this was the policy.  WHAT??!!!???!!??

After receiving this devastating news, I started calling and logged every call by dates, times and names of all customer service reps that I spoke with.  I even called the chairman and eventually spoke with his secretary, however I was transferred back to the customer service rep.  Additionally, sent numerous letters by via certified mail and by fax.  No one will except mine nor my lawyers call(s).

Moreover, this process has been the most long enduring and flustrating process we ever been through.  All we want as a family is to get closure.  We have sent letters and made numerous phone calls to this company and are getting no where.  This house is our life and I don't think its fair they are holding the title AND our money hostage.  Can someone please help??!!???!!??

I am so sorry to hear about your Mother and the troubles you are having settling her estate. You need to put an end to this back and forth with Ocwen. They are a subprime servicer that is one of the worst in the country. It is pretty clear from your post that there is a remainder amount due to the lender and that amount, no matter how small, can create huge issues for your Mothers' estate. I have an easy solution for you, go to one of your local real estate title company's or a good real estate attorney in your area and have them order a payoff for you. They will respond more favorably to an attorney or title company than they respond to their customers or heirs of customers. Once you receive the estoppel letter from Ocwen complete the payoff to Ocwen through the title company/attorney. It is worth the small amount that the attorney or title company will charge for this service to have it done right. Otherwise, Ocwen can and will do whatever they can to take the property (I have seen it).

Make sure you receive the escrow balance after they acknowledge receipt of the payoff. Ocwen is required to refund the escrow balance to the borrower or the borrower's estate within 30 days. Ocwen is also required to send a Satisfaction of Mortgage to the borrower; or, in your case your Mother's estate.

Make sure you record the Satisfaction if the lender did not do it prior to sending it to you. That is the document you are looking for now; a recorded Satisfaction of Mortgage, not the 'title'. When it comes to real property the owner has the deed in their name and a title policy from the time of purchase. What you are looking to do is get rid of the lien that the lender has on the property. That is what the recorded Satisfaction will accomplish.  Ask the title company or real estate attorney to explain this to you so you have a clear understanding.

My suggestion would be to contact all of your Local TV News Stations and send them a copy of your Ripoff Report along with as much information as possible. Put it to the attention of 'Investigative Reporter'.

You can also send copies of your Ripoff Report to FRONTLINE and to Democracy Now! Both of their addresses are available at this site. Just type in 555030 and scroll down to the consumer comment that was posted on August 27, 2012 at Ripoff Report #555030. (The addresses appear at the beginning of that consumer comment.)

Exposing your problem on TV is probably your best bet. Maybe one of the Investigative Reporters will contact you and help you. I am certain that Ocwen does not want to be exposed on TV.
