I was contacted by this company about a week or so ago. I immediately looked them up and found the complaints here on Ripoff Report. They are attempting to collect on a credit card debt that yes, I do owe and yes, I have not paid on for almost a year. My husband was out of work for over a year. I figured a roof over my head was more important. I digress.
Today I called HSBC, the original holder of the account. They stated that my account had been sold and gave me a toll free number to call. I called the number and got a company called Cavalry Portfolio Services (of which I've read other negative remarks but so far, my dealing with them has been pleasant and professional). I explained how P Scott Lowery was trying to collect this debt but when I called HSBC directly, I was referred to this collection agency. The lady I spoke to explained that she had very recently received my account and that it definitely belonged to Cavalry. I made a payment arrangement with them immediately and while on my cell phone, P Scott Lowery called my work number AGAIN. I spoke to a Jerry Williams who was belligerent, mean, inconsiderate, nasty, aggressive, unprofessional and disrespectful. He RANTED at me about not wanting to pay the debt and calling my county and something about wage garnishment and when I tried to explain how I had called HSBC and gotten Cavalry, he just seemed to go ballistic. I quickly told him "this call is done" and hung up on him.
The lady from the other collection company heard it all, as she was sitting there on my cell phone. I paid my first payment to them, thanked her for her kindness and disconnected our call.
I proceeded to call a local attorney to find out what to do to be prepared. I was told that I should have no contact with P Scott Lowery and that I had done the right thing to make arrangements with the company who can prove they own the account. I also called Cavalry back and asked to have my agreement with them put in writing and emailed to me along with their "hello" letter in case I need to go to court against Lowery.
I read MANY of the complaints about P Scott Lowery on this site and I will be calling the BBB and other agencies that have been recommended. It has also been suggested to me that Lowery knows they don't have the account anymore and are trying to get me to pay them before I find out.
I am not sure if my issue with them will go farther or if it ended today, but whatever you do, if you are contacted by these people, PLEASE be careful and keep a cool head. If they are calling on a consumer debt (like a credit card), call the original holder (in my case it was HSBC) and find out if P Scott Lowery really does own the account. If not.....prepare to be spoken to in the harshest, most unprofessional manner possible from these jerks. Call an attorney and find out your rights in your state. As many other people have stated, Put everything in writing to Lowery and make sure you have proof of sending (fax....apparently they hate that).

I hope that you did not give any debt collection agency your checking account numbers...if you do, they'll raid your account i...It's always a bad idea.
Regardless of how nice they might have sounded on the phone, Cavalry Portfolio Services has a lot of complaints...be careful when dealing with them.
Always get a settlement letter from debt collectors BEFORE you pay them
