My fiance and I would like to show an expressed interest in class action civil litigation against PHH Mortgage Services. They are a joke! Prior to me moving into the property, my fiance was in bankruptcy and the mortgage payments were inclusive. In July of 2009, the bankruptcy was finalized and direct payments were to be resumed. Upon contacting PHH, we were advised they could not accept payment, because their system reflected the bankruptcy was still active. We immediately forwarded the final bankruptcy decree and they still would not accept payment. Each time we called, there were extensive holding times; only to be connected to someone in India. They would not provide any account information and when a supervisor was requested, we were again put on hold from 45minutes to over an hour; just for the next person to hang up on me.


In November 2009 and January 2010, we were sent a modification package and immmediately returned them on each occasion. In the meanwhile, PHH still would not accept our payments, stating the bankruptcy was still active. I again forwarded the documents to substantiate the bankruptcy had been discharged. Approximately 12 days later we received a letter of intent to foreclose; requesting the amount of approximately $5495 within the next 30 days, to cure the debt. We immediately contacted our bankruptcy attorney and trustee and she forwarded a letter stating our position; in addition to sending a cashiers check in the amount of $5496. Our attorney also submitted our payments for the next 2 months (February and March); which totaled approximately $1546. They returned all payments with the attorney's letter attached, stating we were in foreclosure and contact was to be made with their attorney Morris, Sneider and Prior.


Upon contacting their alleged attorney, we were advised they have no knowledge of who PHH Mortgage Services were and had the faintest idea of what they spoke of. They also stated our property was not listed in their system at all. Not to mention, on each effort to check the status of the modification, we were advised its still under review. It is now April, 2010 and it's still under review. On April 1, 2010 we sent this month's payment in the amount of $773.26. Basically, we are awaiting this return by mail; as well. We have tried to pay them with certified funds from July, 2009 up until this present date; only to have them return the payment. Can someone please tell me what their motive is and how we can resolve this problem?
