I am a 58 year old woman who works hard everyday to take care of myself and my family. I support myself because i am divorced after 25 years of marriage. I resently checked my credit report after being denied credit and found that Pinnacle Credit Services had an account in collections for $328 against me for a Verizon bill they claimed I owed. When I called to investigate this claim the account was not even under my own social security number so it clearly was not my own however the company claimed the only way to remove the negative mark on my credit was to pay the debt. The account was paid to Cross Town Law #phone (855)389-8696. After two months the faudulant account is STILL showing in collection on my credit report. I have made a number of calls complaining but have only been hungup on and told they can not remove this from my credit report.  This is very unfair and has caused me to be turned down for much need help! If there is anyone who can tell me what to do please email me or something!

There are two federal laws that protect consumers. The Fair Credit Reporting Act (FCRA) and the Fair Debt Collection Practices Act (FDCPA). From what you have posted, it appears that they have violated your rights repeatedly.

You can not be charged for debt that is not yours, you NEVER should have paid, especially since the ssn don't match. You paid and then they didn't remove and refuse to remove the data, violation. They were deceptive in accepting your money, the list just goes on and on, from what I can see.

The first thing you need to do is gather all the paperwork, correspondence, emails, checks then, create a diary of events in time sequence, note, best you can, the date, time, who you spoke to what was said, review phone records for dates.

Then look for a consumer attorney in your area try consumeradvocates.org, the internet, the phone book. The law provides for his fees to be paid by the opposition if you win, and you will win, if this happened as you say.  He can take your case on a contingency basis once reviewing your files. The initial consult should be free also.

Then do as he says and wait for the call to collect the check, along with your money back if it wasn't you.

 Google the two laws, look at what is prohibited, see which are applicable to you. Even if they claim this was a rouge employee, its a violation, as there need to be procedures in place to prevent violations by employees. Also, each credit reporting agency they report to is a seperate violation, so its 3X the damages if they reported to all three.

ps: Once you have a lawyer, they are not allowed to contact you, if they call write down the date, time and any message they leave, advise your attorney at once.
