On March 6, 2006, A female representative from Pioneer Credit called me at work (another debt collection agency) which I fully informed the rep of and advised that I can't have calls at works and advised them not to call my place of employment again she still continued with the call trying to verify my social which you have to do before continuing with giving specific account info. I never verified, but I did say that I wouldn't be able to make any type of payment arrangement right now (which does show that you are aware of the debt) and again repeated that I was at work and that it was an inconvienient time. She said well what time will you be home advised that I don't have a home number she said we have one listed, asked to have it repeated back and it was my cell phone. I then advised her that that is not a home phone that it is a cell and that they cannot contact me on that (you can not collect a debt by incurring debt FDCPA) Then a Male supervisor got on the phone.

Advised him that at this time there is no payment option available he restated the nature of the debt and somehow my $42k debt turned into $66K which is completley amazing in 3 year time since i just reconsolidated so if they try to tell you that somehow they don't over state loan amounts and they have other options, of course they do, but unless you're making $35-$50k per year they aren't really any good payment options. But a warning for Pioneer and some assistance to those who don't know about Debt Collection

A) Even if they make mention of knowing about the debt you still have to verify you are talking to the correct party (that's why most phone calls are not recorded and even if they are the tapes end up being lost)

B)If you tell a collection agency to stop calling work They Must STOP! (So please call me again at work it's been recorded by our phone lines and by a third party monitoring the conversation)
PS if someone tells you they work at a collection agency you MIGHT want to pay attention because most collection agencies have attornies on staff! HINT HINT

C)If you do have a student loan in default YES they can garnish your wages, but if it's not directly from the US Department of Education (who can garnish up to 15%) They are a collection agency and can only garnish up to 10% http://www.ombudsman.ed.gov/garnishment.html

Just to let the public know who are not aware of debt collection practice. Make sure you record or have a second party on the line, If they do call work or call home who can be a witness to the call if you do feel like you are being harrassed, also in all honesty if you do not identify yourself or acknowledge the debt they should not be giving you any account information and if properly recorded and witnessed will be a violation of FDCPA.

Also companies like Pioneer work on what is called a fee, so they can threaten that they are with the government, They Are Not! They are a collection agency who make money through a fee scale, and when doing collections on a fee scale for student loans, the fee scale they have to hit to make Bonus is incredibly large and if they want 10% from a garnishement on a person who makes $25.000 a year than that's fine, it's more laughable than anything if you do the math the garnishment is far more less than any payment option they may offer, and while that might be bad on your credit, if your credit is already down the drain (not saying that it can't be fixed) then it's more of laugh for you and a nuisance for them. So if may wages were to get garnished It would be annoying, but 10% on $25,000 a year hey have at it because most of the employees working at the company now if it's still in existence for 26.4 years won't benefit from the garnishment.

This goes out to the troll for Pioneer.

I bet you're not telling him to pay his bill now that ya'lls butts got fired from Department of Education along with the other three rouge companies and when you tried to sue the Departement of Education, the Judge still ruled in favor of ED because even the judge knows how crooked you all are.

Tom,

I never had a student loan in my life. Therefore, I never defaulted on a student loan.

I got all of my education compliments of the USAF and CCAF, and a few technical schools.

Where did you get the idea that I defaulted on a student loan? Please explain.

HA HA I have a loan from ED and people from PCR call and call They think they can scare me into paying my debt RIGHT NOW or they will garnish.

Well guess what I called them out and said help yourself. Guess what they backed down.

Oh I understand that they or you if you work there can be rude, Well I can dish it out REAL BADD. I told them go on garnish,What does it matter to me the load will payed so back off.

They told me that it will show on my credit report, I said SO. Here is a little news for those that may read this: After the loan is paid either by garnishment or other you can ask the Dept Of Ed to take it off of your report and they will.

Do believe me? Go to the Dept OF Ed web site and read all about it.

After all was said and done they were kiss a#$ helpfull no I can settle for less than I owe.

So as I like to say not everyone in Texas is a redneck, So take that home with ya.

Steve:

I understand that you 'beat the system' on a student loan somehow. I am reading your point of view and in several cases you have some merit.

-Stat barred and reaged debt.
-multi selling of settled debt to recover the remainder that was SUPPOSED to be settled.
-medical debt that was supposed to be covered.
-phantom debt, made up to gouge free money off folks if they just pay the d**n thing to get the agency off their back.
-old charge off debt that is better letting sit until it comes off the bureau -instead of paying it and re-setting the 7 year clock .

those are just a few.

However Steve.

Do you know that you are also announcing that you have no problem in the slightest getting a student loan and RENEGING on the promise to pay it back. You dont seem to give a rats a**. In fact, you find some exuse how they 'jacked you around' so that you dont have to pay $1000s of dollars.

Thats just great. Woo h*o. That makes it so much easier for kids to go get a student loan now doesnt it?

Kids need an education. According to you, they should NOT PAY any of it back, until they feel in their minds they were 'JACKED AROUND' as an exuse not to pay it ever.

Just great. If enough people think in this ULTRA self centered way , THERE WONT BE ANY MORE STUDENT LOANS , now will there?

I know steve, YOU just want to get away with it. Everyone ELSE should have to pay their student loan back.

'..if they didnt 'jack me around' i wudda paid em back blah blah blah blah........

So, who ripped off who here steve?

The goverment or agency should write up a ripoff report on YOU steve, how you RENEGED ON YOUR STUDENT LOAN.

Your letter seems to indicate that you are trying to avoid paying your debt.

When you consolidated your debt you allowed the consolidation company to consolidate your interest as well. At that point you began paying interest on the interest you had on the original debt.

Failing to pay your debt in a timely fashion was your first mistake, failing to read the fine print on your consolidation agreement was your second.

You seem to think that when a student loan goes to a collection agency, the agency is collecting the funds. They aren't. The government doesn't sell Federal debts, they employ 3rd party agencies to collect for them. when you are being garnished, the Federal government is garnishing you.

What is missing from your logic is the fact that you gave your word to pay a debt and then ran from it. Blaming others for your error seems more important to you then attempting to correct the problem. Not understanding the details of your consolidation loan indicates your education didn't "stick"

Refusing to take responsibility for oneself is not a quality an educated person would brag about.
Attempting to get an education for free with taxpayer money is known as stealing.

There is no debtor prison in our great country. The Federal government continues to lend money to people in need despite the fact that there will always be a percentage of people who steal.

I can show anyone how to present living expenses that exceed available income, or come very close.

Realisticly, anyone taking home less than $400 a week has very little, if any disposable income.

Therefore, very little, if any garnishment.

A very simple concept.

First of all, what does female have to do with anything?

The OP is in FL. You CANNOT get more than 15% of that person's income. Period.

Got that? Federal law DOES NOT always supercede state law.

I have squashed your type on a regular basis. You have no idea how the real world works.

I have beaten attorneys and got lawsuits dismissed before ever even getting into court.

I walked away from $170k almost 5 years ago and have not been successfully sued and not 1 penny has been garnished. I have no judgements on me to this day. The debts are now past SOL, and are uncollectable.

I know every angle of collections and fed law.

I helped 2 different friends with Dept of Ed garnishments. They have not paid 1 dime either.

You are a joke and so is the dept of Ed garnishment.

Department of ED is Federal they go above state laws on garnishment. You can be maxed at 25 percent depending on if you are being garnished by more then one bill. If not, then 15 percent is the amount of the disposable income.

Borrowers can file a hardship thru proof of income/debt ratio. Taxes are taken by ED and the IRS.

The Debt Collection Improvement Act of 1996 permits the Department to garnish up to 15% of disposable pay(and they do 15%).

This is how the goverment garnishes wages,
ED(not the agency) starts the garnishment process ITSELF by sending the borrower a Notice of Intent to Garnish (SO2 Letter), which gives the borrower 30 days to file a request for review of objection(s) to the garnishment action and states his rights under the process.

The Debt Collection Improvement Act authorizes federal agencies or collection agencies under contract with them to garnish up to 15% of disposable earnings to repay defaulted debts owed the U.S. Government.

By the way, I am female. Pioneer is on contract with Dept of ED, we are paid by them. All funds that borrowers send go directly to them.

Once again you have no idea of what you speak of.

Wage garnishment in FL for anything other than a FEDERAL debt or state tax obligation is limited to 10% of your DISPOSABLE income.

Here is an excerpt from the State of FL website:

If you default on your loan, the U.S. Department of Education has the authority to deduct money from your income. This may happen through tax offset or wage garnishment (or both).

Tax Offset. The Department of Education may offset, or withhold, money from your federal income tax refunds to collect on defaulted federal student loans.

If the offset of your federal tax refund creates a severe hardship for you, it is possible to request a refund. Examples of extreme hardship include very high medical expenses or the threat of eviction from your home. To request a refund, you will need an explanation of why the offset is causing an extreme hardship, a copy of your income tax form and other proof of income, copies of your monthly bills, and, if possible, copies of the bills that represent your case for extreme hardship. Send this information to your guaranty agency.

Wage Garnishment. If you are in default on your student loan, federal regulations and law allow your guaranty agency to garnish up to 10% of your disposable income, or the U.S. Department of Education to garnish up to 15% of your disposable income for repayment of your student loan.

you need to read the garnishment laws in your state. a total on 25% can be garnished of your income after taxes before benifits. dept of ed takes max 15 % need to check the laws. how long have you been collecting?
