Well, My husband and I are in the process of filing for bankruptcy; I have a complete list of what collectors are and are not allowed to do; either I've been misinformed, or Portfolio Recovery is training their uneducated moronic collectors not to follow certain ethical or legal guidelines.
They've been calling me at work. Yes, as work; after I've repeatedly told them NOT to contact me there; AND given them my lawyers address, informing them that I must have something writing.
Today, I went through the same thing and the collector questioned me; "Why? Dont you know your own debts, do you have your bank statements?" I told her it was none of her business and to send a letter to my lawyer. She tried to argue with me "Mam it is my business because I am with a collection agency"; I asked to speak to someone else and she just would not let up and then finally put me on hold...I waited 20 minutes and finally had to hang up because I was at work.
Am I wrong here? I dont see how it's the collectors business what I do; it's only their business to get the money. I am certain that they are not allowed to contact me at work (at least in the state of MO) if they've been asked to; and that they have to cease contact with me if I've given them my lawyers info.
Do I have to get in touch with them to get my lawyers address to them? What is my next step.

Hi Stayci:
I have had trouble with these people also. I followed the directions that folks gave me here. I have not received any more calls yet. Put it in writing that you wish a detailed accounting of your debt.State that you will not accept any phone calls from now on and send it to them but make sure to send it certified with return receipt.
If they call just tell them you will not discuss this over the phone and hang up. Mrs. Payton assured me that she had sent all the info(a lie)and told us lots of people say they don't receive things in the mail. It is there obligation to prove you owe a debt not your to prove you don't.
The address is in my complaint, Medina, Ohio. Good luck as they are abusive in the way they lie and conduct themselves.

You mentioned that you have told them you were being represented by counsel, and gave them an address. Did you give them a phone number for the lawyer? Without the phone number, they have no way to verify that you are being represented by counsel. It comes across as a stall tactic to them, rightly or wrongly.
And you are right that they are not supposed to call you at work once you have told them not too. However, Massachusetts is the only state that has a law stating a verbal request has to be honored.

Talking on the phone will get you nowhere, this company will only lie and claim they don't even have your phone number.
have your attorney and/or you send this agency a stop communication letter:

this company will lie, attempt to re-age old debts. won't validate, and when and if they can it will be only in house memo's, there own print outs or emails they pass between themselves.
file complaints against them with the F.T.C, your states attorney general, and VA. state attorney general.
keep copies of every thing you send, and have them sign for it.address it to Ms. Robbins, so when this company continues to violate the law and fdcpa. and they will, you can also complain to the Va. bar assoc.
record any calls you can.
