In early 2002, we had problems with our hot water heater which was still under warranty with Sears. We had numerous service calls, were without hot water on approximately 3 - 4 occasions and the tank still would not work for more than a day. Finally, the tank was condemned and a new tank was installed by Sears on June 28, 2002.

The tank worked for approximately one year after that. The second week of June, 2003, the hot water tank again failed and we were without hot water for approximately 5 days. The repair person came out and replaced the thermocouple and the tank worked for another 7 - 8 days. Now, on June 29, 2003, we are again without hot water and this latest installation is still under warranty with an extended one-year warranty.

I called Sears home repair only to get an answering service because it is Sunday night and the repair service will not be open until 7:00 a.m., EDST. Now, I have to wait until tomorrow for a call back on this useless hot water tank. There and 3 other family members who have to go without hot water and I am very tired on Sears tactics. What can we do?

master protection lemon law

I work for sears, they will only replace a unit if it has had 3 functional parts replaced in a rolling 12 year period. comming out to your house for 3 or 4 times won't cut it. If you are really upset take your receipt and head back to the store on a bussy day and start comlpining loudly in front of the potential customers. the manager will then gladly help you.

Chose your contractor wisely

This is my opinion based on experience. Sears and other department stores are not "TRUE" contractors. You have a very necessary appliance that needs to preform year after year. Sears hires middle men , licenced plumbers,to install their products.

My suggestion is to go to a local Plumber with years of experience and a good reputation and by a superior product through them. Remember Local plumbers do not want to sell you credit cards and have every day hands on experience. They know which mfg of water heaters work they can carry many differnet brands for many different applications.

Who will sell you a water heater? Someone who deals with many mfg or a 19 year old comm sales person?

Try This ..Master Protection Agreement has a 'No-Lemon' clause.

Did you purchase a Master, Repair, or Value Protection Agreement?

The Master Protection Agreement has a 'No-Lemon' clause. Which means that if it takes more than 3 times to fix the problem, they will replace the whole unit. Best Buy has this policy also.

I would look over your warranty again and see if this is included.

Also, Sears will replace the water heater if they can't find any suitable parts or technical knowledge. Which from what I've read you might have a good leg to stand on.
