I contacted this company around September 2010. I was in search of someone to paint the trim on my house and also to put new tile in my bathroom. They told me their contractors were bonded and licensed and had been thoroughly checked. I don't think that's true for the reasons I'll outline below.

I hired Shawn Walton, dba The Handyman, to finish painting the trim on my brick house (part of it was already done) and to put new tile around my bathtub.  He missed a part of the house when painting and had to return on a Sunday to wrap it up. He didn't pay attention to detail. He acted as though he really knew what he was doing and that he'd done it many times before.

About a month later, water was getting trapped between my bathtub liner and the tub. This caused a good deal of danger and inconvenience and an unhealthy condition. I'm having to spend over $3,000 to take care of the problem. The tiles have to all be taken out and the job done by a true professional. Plus, I have to take the tub out and put a new shower in. Totally redo the bathroom.
This was due to the caulking job he did around the tub. It lasted about four weeks then began to wear away from the tub. I don't know if it was due to the caulk he used or the way he applied it. Either way, it was a bad job --- a job that is costing me time, worry and money.

I had two professionals look at the job. Here's part of what each independent professional reports to me:

- Walton used the wrong tile. He used floor tile and not wall tile
- He used the wrong caulk
- He used the wrong grout
- He did not line the tiles up - you can easily see they're mismatched and botched up.
- He did not level the tiles
- He did not seal properly, leaving water to get trapped between the tub lining and tub.
- much, much more . . .

So, while his fee was low it turns out he's very expensive in that I had to do much more work at a much higher cost because of his failure to tend to small, but extremely important details.  Servicemagic will not pay me $1,000 even though I'm a premium member. I joined as a premium member after hiring the above service provider. And they are dragging their feet in even paying me the small amount of $500 for a standard member --- even though I submitted all the documentation, and more, than they asked for.  I advise anyone looking for a handyman or any other sort of help to avoid this company and search on Angie's List or someone reputable. I'm very sorry I contacted these people. They're just out to make a buck on both the service provider and the client and don't seem to care about the quality of the work the client gets.  As I tell my own prospective clients, "You get what you pay for." Unfortunately, I failed to listen to myself. Now I'm paying for it.

Service Magic Won't Pay Until You Sign Agreement Not to Talk.

Service Magic offered to pay me $500 in return for me signing a contract stating, among other things, that I would not talk to anyone except my attorney about my experience with them. I asked them to take this clause out and they refuse. It's inconceivable to me that a company would ask you to do this when a simple release form would suffice. Obviously, they're trying to limit their liability plus limit the things people say about them and their service.

Part of their Terms read as follows:

" RESOLUTION PROCESS AND LIMITED SERVICE GUARANTEE. While we cannot guarantee the work performed by a listed service professional, and

while we have no obligation to you with regard to your relationship with a service professional, the ServiceMagic resolution process has been developed to

try and assist you in resolving any workmanship problems that may arise in the course of a home improvement repair or maintenance project and which may be

the fault of a service professional who you learned about through the ServiceMagic services. Under the circumstances more fully described herein and upon

completion of all required procedures, although we have no such obligation, we may, upon your request, provide limited assistance in resolving disputes

between you and a service professional. You must participate and use good faith efforts to resolve problems through the ServiceMagic resolution process. If,

in its sole discretion, ServiceMagic determines that you have not participated and cooperated in good faith in the resolution process, ServiceMagic may

terminate such Resolution Process and the Limited Service Guarantee (details). Such limited assistance in no way nullifies the release and indemnification

described in these Terms & Conditions."

RESOLUTION PROCESS AND LIMITED SERVICE GUARANTEE.


To be eligible for the Resolution Process and the Limited Service Guarantee, you must be a consumer member of ServiceMagic who has agreed to be bound by our general Terms and Conditions, and have used a ServiceMagic Member Service Professional who was referred to you by ServiceMagic in response to a Service Request submitted to ServiceMagic. You must also have entered into a written contract or agreement with the ServiceMagic Member Service Professional within 90 days from the date that your Service Request was submitted. The Resolution Process and Limited Service Guarantee are not applicable under the following circumstances:

















































































































i.work that is performed without a written contract or agreement signed by both parties;
ii.For work performed by someone other than the ServiceMagic Member Service Professionals that were referred to you directly by ServiceMagic in response to your Service Request;
iii.For any materials, equipment, appliances or other machinery, whether or not provided by you or the Member Service Professional;
iv.For work that extends beyond the scope or description of the original Service Request you submitted to ServiceMagic.
v.with respect to Service Requests that are not for an individual consumer requesting service for the consumer's residential property (i.e. not applicable for Service Requests submitted by commercial entities such as property management companies, real estate investment companies, or home builders);
vi.If you have not contacted ServiceMagic customer service via phone, e-mail, letter, fax, or online "live chat" within 30 days following the completion of the project;
vii.For breaches of contractual obligations or agreements between you and the service professional;
viii.For liens placed on your property by the service professional.
x.If you have failed to seek a remedy directly from the service professional.



Documentation: ServiceMagic takes all complaints against our Member Service Professionals seriously. To initiate the Resolution Process, all complaints must be thoroughly and accurately documented in writing and copies of all related documents, including original signed contracts or agreements, evidence of payments, signed change orders, etc. be provided up front. Should you choose to lodge a written complaint against a ServiceMagic Member Service Professional you are acknowledging that ServiceMagic may share your complaint with the Member Service Professional. We may notify a Service Professional of a consumer complaints related to a consumer's ServiceMagic Service Request





Facilitating Communication: Our experience shows that in most cases, communication between you and the Member Service Professional can resolve most problems. ServiceMagic will, at the request of a Consumer or a Member Service Professional, attempt to contact the other party and relay specific concerns related to a ServiceMagic Service Request. We will endeavor to help both parties reach a mutually acceptable resolution to any disputes. ServiceMagic is not responsible or liable to either the Consumer or the Member Service Professional if a mutually acceptable resolution is not reached.





3rd Party Evaluation: Based on having initiated a proper Resolution Process, including the Consumer's provision of all required documentation, and in the event that a Consumer and a Member Service Professional are unable or unwilling to agree upon a resolution, ServiceMagic may elect, in its sole discretion, to have another ServiceMagic Member Service Professional ("Reviewing Service Professional") inspect the service or project, potentially including a job site visit and interviewing the Consumer, and render their opinion to ServiceMagic as it relates to the workmanship and service of the original Member Service Professional. If ServiceMagic chooses to employ this approach, which is solely at ServiceMagic's discretion, then the Consumer must accommodate such a visit and provide complete and accurate information to the Reviewing Service Professional.





Limited Service Guarantee: In the event that a Consumer and a Member Service Professional are still unable or unwilling to agree upon a resolution, the Consumer may, in ServiceMagic's sole discretion, be eligible for the Limited Service Guarantee. To be eligible for the Limited Service Guarantee, the Consumer must:
























































1.

Have provided accurate and truthful information via the Service Request;
2.Have entered into a signed (by both consumer and the Member Service Professional), written contract or agreement for a home service or project within the scope of the Service Request, with a Member Service Professional that was referred to the Consumer directly by ServiceMagic in response to a Service Request;
3.Have supplied ServiceMagic with written documentation describing consumer's complaint regarding the Member Service Professional's workmanship or service and provided all requested additional documentation;
4.Have complied with any request by ServiceMagic for a 3rd Party Evaluation;
5.Have complied with all of the terms described herein.





In the event that all above conditions are met by the Consumer, ServiceMagic may, in its sole discretion, grant the Consumer the Limited Service Guarantee in an amount equal to the Consumer's actual out of pocket monetary losses, such amount not to exceed $500 (or higher amounts for consumers with premium memberships)(the "Limited Service Guarantee Amount"). ServiceMagic shall have the right to choose whether to have another ServiceMagic Member Service Professional ("Remedy Service Professional") provide service to remedy the workmanship or services in dispute, and in such case ServiceMagic may, in its sole discretion, pay the Limited Service Guarantee Amount to the Remedy Service Professional directly, or directly to the Consumer. ServiceMagic reserves the right, in its sole discretion, to determine the form of the Limited Service Guarantee Amount."







When you get the contract, you're greeted with a lot of CYA plus the clause that you agree not to talk about your experience with the company.

My advice is that before you do any business with this company, you consider options. You might be better off doing business with a reputable local company even though you may initially pay more.
