Whilst serving our country in Iraq my son a US Marine found the car of his dreams online. He purchased the car and we took it to him upon his return to Camp Lejuene in Jacksonville, NC.
Whilst driving it in Jacksonville he was sideswipped by another person and extensive damage was done to the car. The other party was found at fault by the police and ticketed for the accident. USAA was the insurance company for both parties.
The car was independantly valued and declared as a total loss.
USAA wants to settle the claim for $5000 less than the car was valued at. They refuse to negotiate. We have contacted lawyers and they basically are not interested in the case as they say it will cost more than the $5000 to collect it from USAA. They advised me USAA knows this and thats why they routinely do this to people.
I find this despicable for a company which claims it was formed by a retired general to assist service men and women with their insurance and banking needs.

IF they are really low balling you significantly below the "private party" value of the vehicle you can SUE the PERSON who caused the accident.

The person who caused the accident is ultimately responsible for your damages. Part of the problem is that both parties are insured by the same company.

Years ago, I had a similar problem with the insurance company of the person who HIT my car while he was making an illegal turn. The insurance company did not want to pay to have my car completely repainted (custom paint-the shop that had painted it could not guarantee that they could match the paint.)

My uncle (an attorney) told me to sue the person. Shortly after this person was served with a summons, I received a call from his insurance company and they paid to have the car completely repainted.

Have you requested a different claims adjuster to take over your case?

Have you even spoken with a claims supervisor yet?

How many appraisals have you recieved for the vehicle?

Have you questioned why or how USAA is coming to 5000 less than the appraised value?

If you haven't at least done these first the lawyer route was probably not the best route to take so quickly. If you want cooperation for USAA's claims department (or any ins. co. claims for that matter) you need to come to them with evidence that you are correct in your claim that the vehicle is worth 5000 more than they are offering.

Insurance claims departments respond well to things in threes. Have them do their appraisal on the value of the vehicle, then take a look at the kelly blue book value(kbb.com) maybe even NADA.com as well (Bear in mind, the ONLY vehicles considered in excellent condition are the brand new vehicles still on the lot.) and lastly look through something like the auto trader, find one comparable in there and then go to the claims department and say ok, here. look at what i have found out....
