What, exactly, will your lawsuit allege?

Will you sue them for raising your escrow payment for increased property taxes?

Will you sue them for raising your escrow payment for homeowner's insurance?

"one minute you have money  in the account and the next minute it is gone and they dont know happened to it ."

They know what happens to it, you don't.  It pays the above mentioned taxes and insurance.

If they have "gone up on your payments and escrow" what did they tell you when you asked them about the "payments" part of this"

The contract you signed allows them to collect appropriate amounts to have the funds available to pay your expenses when they are due, and they are YOUR expenses, NOT theirs.

"They blame on anything from late payments to increases on your insurance."

Now why would they want some extra money to make up for your late payments, how rude of them.

Here's a thought for you, if they didn't maintain an adequate escrow account to pay YOUR bills when due, would you reliably save adequate amounts to pay them yourself?  I already know the answer and that's why you pay into an escrow account.
