I called to complain and ask for a refund.   They said this fee was started earlier this year and is to offset the discount on the phone upgrade. 

This is deceptive because it masks the true cost of the upgrade.  They advertise one price, then charge a higher price.

How can this practice possibly be legal?

 EVERY CARRIER HAS A UPGRADE FEE!!! There is no true "free" upgrades unless the carrier in question is running a promotion. This cost is used because you fellow consumers like to commit wireless fraud. Because of this EVERYONE has to pay. Sorry its so upsetting for you to have to pay what everyone else does. This isnt a ripoff. You would have been told about this fee upon signing back with them. It is always stated clearly somewhere on your printed contract. If you did a digital contract, then these fees would be spelled out for you online.
