Wells Fargo Auto Finance has been harassing us. I financed the vehicle using my detailed 12 page power of attorney while husband is overseas in Iraq working with the allied forces. He was injured while overseas, and we fell behind. Calls in excess of 25 per day, and after 9pm at night ocurr daily. Messages left on my answering machine asking me what is going on in my head, what is my frame of thinking, accussations of hiding behind my message recorder, contacting my elderly in laws (ages 70 & 90 yrs) and asking them various personal questions.

Located my husband at his new camp in Iraq, and speaking with his workers. Asking them about his work hours, his marriage, exactly where he is located.
The foreign workers let my husbands boss know that these calls were coming in, and that they didn't know what to tell this wells fargo company. Husbands boss told husband to handle his personal affairs. Husband called Wells Fargo, and told "Matt" to stop calling, that it was costing him his job. Matt said, "okay", but continued to call, and also leave detailed messages.

Was told by a W.F. supervisor that the SCRA would not save us. I told them he was injured, I sent his travel orders to them, told them prior to the injury we were on time. They said, "what does your personal problems have to do with the fact that you signed a contract with us?" Demeaning messages left on voice recorder while company is visiting my home. A friend has recorded most of the phone calls, one of which I was asked what my husband is doing with his money because he makes good money, and should be able to afford the vehicle. We are at 21% interest, and pay almost $900. every month until we fell behind. Have full coverage, which puts our total monthly payment to almost $1000.00 per month.

Most messages have been recorded, and I still have copies of the messages that were left. I am seeking a good attorney at this point. All of this has affected my health, my husband is concerned and upset, my kids check every morning to see if our 2005 Chevy Tahoe is still parked in the driveway. I am frustrated, disgusted by their actions, and feeling violated. I am certain that we have a good case. The question is how to find a good attorney who can review the messages, all of my correspondance, and the fact that my husband was located somehow in Iraq, when I have a power of attorney on file, and the asking of such personal questions to my husbands foreign workers. What to do??

If your husband was active duty military deployed or a contractor, him getting hurt should not affect his pay, especially if he stayed out there after his injury. The SCRA has nothing to do with someone getting hurt, it is used to protect you if your husband was military and was not able to make payments on your home because he was making less deployed than he was back in the civilian sector.

No, if he is a contract worker, the SCRA doesn't help, but, you have alot of things against them. They are not allowed to contact him , or employers at work. For instance, if he says " I can't take calls from work", they cannot call. If your husband lost his job because of this, he has a case. The can only call other such as you said regarding your elderly parents ( which is just sick by the way). They can only call other people in an attempt to locate. They cannot in any fashion disclose what the call is for. To anyone but the person on the note.

They , in your instance, are in violation of the Fair Credit reporting act.

Depending on which state you live in, it may or may not be legal to record the calls unless you notify them that you are doing so. In other states, you can and not have to tell them. So check your state laws regarding that.

It is my understanding that several suits against these practices, are in the works, specifically, against Wells Fargo. I will also include the name and address for the VP of Collections at Wells Fargo. Send him and e-mail, and follow up certified letter that no one is to contact anyone regarding this account except for you, and if you husbands name is the only one on the account, have him give you a POA ( Power of Attorney) you shouldn't have to , but they will try to say you do.

so write them via e-mail, and fax is even better, a letter stating any call restrictions. For instance," we can not take calls at work" You are not to contact anyone but mme, and I am available at ______ time of the day. If you are busy, you are within your legal rights to say " this isn't a good time" and give them another time. If they continue in spite of you telling them, not to call work, etc etc, they are inviolation of the Act. After 9:00 is illegal.

FAX him a letter and tell him the restritions on phone calls to your husband , his pace of employment and any other times that are not convienient . The have the right to discuss the account with you. so give them a time. Other than that, they cannot harrass you, but they are trained to.

Mr Alverez will tell you about the same stuff that the colletors do. doesn't make it so. state clearly your restrictions in the letter, and get the confirmation of the fax reciept. Keep your eye out for the legal cases. They are coming.

Hang in there and tell you husband to stay safe, and even if he is just working there, we appreciate his service in support of our troops.

Is your husband in the military? Your report says he's in Iraq & 'working with the allied forces", but is he actually in the military or a civilian worker? If he's not in the military then the SCRA does not cover him. Also you indicated that you only fell behind after he was injured. Did he not receive pay during this time? If he was injured in the job or had any benefits, he still should have been paid during this period.
