Last year (OCTOBER) I had contacted my Mortgage company (Wells Fargo) to inform them that I was trying to keep up with the payments and that although I was just at two months late, I was indeed working on getting everything caught up, I just needed some time. I always kept in contact with them so as not to give the impression that I am dodging them in any way.  The representative that I spoke to offered me to apply for the Home Affordable Modification Program, (HAMP), also known as the Obama modification program.  I had no idea what it was, and after her explaining it to me, I agreed to apply.  She pre qualified me over the phone in about 10 minutes and was told that I would receive documents that I needed to complete and return, and I would also need to make adjusted payments on time for a period of three months during the trial.  She calculated the amount my payment would be (which is lower than my actual mortgage payment), and told me the basic guidelines I would need to follow.  I received my packet I sent in the signed documents.  I made all the payments on time etc.  Then it started, every time I would call in to get an update, I was told that I needed to send in another document. They were always processing, or still working on it or analyzing this or it went to this department but that department needed me to re-fax more information and more information.  I believe I resent my information a total of 5 times.  Since no one was getting in touch with me after the trial, I took it apon my self to get my own answers. So I called a representative AGAIN to get the status.....I was promptly told that I did not qualify, and that I was now owing $5800 dollars and that needed to be brought up to date. NO one could give me an explanation of why I did not qualify for the HAMP. I was hung up on, put back to revolve in the que, transfered to several different depts and companies that didn't even pertain to the HAMP or my account. This went on for weeks until finally I told the representative I would not get off the phone until I spoke to a manager.  Manager came, we spoke, she gave me some crazy explanation as to why I did not qualify, and then she said I would be contacted and that they DO have other options.  WEEKS went by, no one contacted me.  No one had any information about anything other than my processor was a Ms. Garcia and she was working on my account, but OH.....I needed to re-send my information AGAIN.  So I did. Still no reply, no contact, NOTHING. I was being processed through something that I was not even told about and was not informed of what options I had.  I called in, Ms Garcia did not reply to my request for a call back. I was refused any number to contact her, or any email address.  I was told by the representative that the only way for me to contact her would be for them to email her and let her know I wanted a call back.  One week, no reply, another email by a rep to her to contact me, another week same thing. This went on and on for weeks till I finally AGAIN demanded a manager...............who once again asked me to fax in all my information AGAIN!  This time he did do what he promised to do, he walked it up to a processor, and within 4 days she called, introduced herself and told me what she was going to be doing.  She asked me to fax in MORE information...........which I did.  Yesterday, I got a call from the "decision maker" we spoke for a while, I answered all her questions and she said it all looked good, but of course she had to send it over to the "investor" for them to review it and agree with her recommendation.  She told me to call her at 4. I called her back and she sounded more upset than I was.  She stated she was sorry to inform me, and she really hates this part of her job, but the investor has declined to agree with her recommendation, and so they have declined the modification.  Then she said that the investor determined that since I had so much equity in my home, that it was more profitable for them to sell my house, than  to modify the loan!!!!!!????   WOW. I didn't even know they could do that to be honest!  The sad part about the whole thing is, I didn't even ask for all of this, it was offered to me..........I was not this far behind when I first started, AND...........this has dragged on since October of 2009 and with the amount of months I was behind, combined with the reduced payments , the negative escrow, the property insurance and the property taxes I am now $7800 dollars behind and they want all of it.   The worst part of all of this is the fact that every time I had called in I specifically asked if my home was sent over to start foreclosure proceedings and I was informed no.  I was on the phone last week, speaking to the processor and told her that I had a letter in my hand that stated my account had been sent over to an attny for foreclosure proceedings, and she told me that she did not see that in her system!

Well fargo does illegal lock outs in Apple Valley California

AUTHOR: Oni - (USA)

POSTED: Tuesday, June 22, 2010

I know for a fact that Wells Fargo does not care about the Real Estate laws in the California area. They are a bunch of lying bunch of Demons as i am concern. They illegally lock my best friend out of his house by using some Real Estate guy down the street from where his house was located at. This was done without any police or Marshalls in the picture at all. No eviction was given no paper work what so ever was ever file in court by there bank at all. Them Demons just sent this Jason Landon guy over from this broker company, and told him to lock out my best friend, and his family members.

They have also stolen stuff in the process from this home in Apple Valley California.
When my best friend called the bank they told him they did not have to contact him about locking him out at all.

So in other words Wells fargo bank is saying screw the laws of Real Estate , and can do what ever i want when i want , and i don't have to tell you a d**n thing.

What a bunch of evil dirty low down folks in that banking area. Also this Apple Valley California Broker who you would think know the law is a bird brain for going over to someone else's house without any document's filed in any court saying this is an lawful  lockout.

So i am guessing now the banks can just come over anytime, and lock anyone out without papers from the court or the police.

That is one reason i don't vote at all. Laws don't work for law bidding folks. Only for the evil minded Demons who use them.

But we have Wells Fargo on the record talking crap about what they did so this will be a start for me i don't like folks who go around hurting others, and not obeying the laws of the land like the good book says.
