Wells Fargo...where to begin

The First Complaint:

Currently we are in the process of going through a Loan Modification with Wells Fargo Home Mortgage after we failed to make one mortgage payment.

I called right away when I missed it and ask for my options. They were completely rude to me and disrespectful. They asked me to fax them all sorts of information, which I of course had to do twice, plus mail it in so they were sure to get it. I would call them every week for updates, since I never received any phone calls or packets/info in the mail. Everytime I called them I would talk to a different person and they would all tell me something different, including if I should make any more mortgage payments and when. I kept telling them "I am not losing my home over a miscommunication from your office".

Well, three months have passed since the initial call and still no loan modification but, of course we still get messages about a possible foreclosure if we don't pay.

I however, I'm somewhat lucky because we have a VA Home Loan so, I called the VA and they called Wells Fargo for me and got me a contact person at Wells Fargo that works with the VA loans. Her name was Rita and I proceeded to leave messages with her for one week to try and get information about my account/loan. After one week of leaving messages the phone one day ended up rolling over to a receptionist and she told me that Rita didn't exist and she had no idea who I was talking about and that "Rita's" extention was not valid. She couldn't explain to me who then I was leaving messages with all week. I immediately reported this to the VA Administration and they flipped. They gave me a new contact for Rita's supervisor and she only called me back after the third message when I threated to report her to the VA and Better Business Bureau.

So, after three months of waiting and nothing she now says they will start to review it today only after I threatened her.

The Second Complaint:

Is actually how we got into the first mess with the mortgage.

We deposit our paychecks every two weeks like clockwork and they are usually for the same amount. For some reason they started holding our deposits for several days even up to a week..In the meantime we were bouncing checks right and left, because we assumed we could pay some bills now that we made our deposit. Apparently that is not how Wells Fargo operates.

Wells Fargo will definately take out withdraws almost instantly but, deposits they will accept at their own leisure.

We racked up almost $1,000.00 worth of fees (overdraft fees and cancel check fees and return check fees). When I called them on it, I basically said we are bouncing checks because you are holding our deposit. They said they had to "verify" the deposit. Even though the deposit is the exact same one we make every two weeks like clockwork for the past 3 years for the same employer. I told them to reverse the fees because it was not our fault they were holding it. They told me I would have to make another deposit to cover the checks. I told them I don't have anymore money to deposit...YOU HAVE MY MONEY, WHY DON'T YOU DEPOSIT.

This is how we weren't able to make our Mortgage payment...The $1,000.00 went to their fees that they caused.

I would be throughly interested in lodging a formal complaint with them. I have already complained to the VA to deter other veterans from using them. And have contact HUD also however, they are already aware of Wells Fargo and their problems and just advised me to move my accounts to a different bank. I will be doing so as soon as I can.

Thanks for letting me vent.......This is just so frustrating that this can happen and very much targeted to the Middle Class

How long are they holding?

Under federal guidelines, banks are required to make funds available on a schedule. The Funds Availability Policy must be available and posted in the branch.

For a local check, they must make $100 available the next day, and the rest in 2 business days.

The bank may choose, for reason, to impose a longer hold. If they do so, they are required to notify you of the extended hold, and when it will drop. If they did place an extended hold, and did not provide notification, then they are in violation of the law. You should sit down with your branch manager and calmly point this out to them.

However, if you were notified, or if you were drawing on uncollected funds within the normal period, you are not only stuck, but you have provided them with the necessary legal reason to extend holds in the future.
