Complaint Review: Western Express - Nashville Tennessee

Western Express Terminated me knowing that I was fighting a DOT that the Assistant Terminal Manager of the terminal that I was working with in Decatur, AL sent me into unsafe weather conditions over the qualcom. RIPOFF Nashville Tennessee

Terminated me knowing that I was fighting a DOT that the Assistant Terminal Manager of the terminal that I was working with in Decatur,AL sent me into unsafe weather conditions over the qualcom. I ended up losing my job and this Ruined my DAC Report and Alabama Suspended my Class A CDL as a result also becase I couldn't pay the Traffic Citation that is Recorded in Moncks Corner, SC.

I have had a lot of trouble out of this Company for 5 1/2 months. I have had one thing after another. Either making me run over on my hours or with the situation at hand with My CDL A License being suspended as of tomorrow because of the Fact that I was terminated before I could even "prove myself innocent" in the Moncks Corner, SC. I

feel that if it wasn't for the Assistant Terminal Manager of Decatur, AL that sent me into that Blinding Rainstorm that I wouldn't be in this predicament as of today. Justice needs to be seved on these people for this misjustice of what has happened.

From the information that you provided I came to the conclusion that you are new to the trucking industry. My advise to you is to get in to contact with the clerk of court where your license was suspended and see what you have to do to have your license re-enstated. I am sure you were found guilty of the violation that you were issued the summons for and owe fines. further more if you do not pay the fine a warrant can be issued for your arrest.

You need to get out your FMCR book and read it. It is the bible to truck driving regulations.

No one in the company IE: dispatchers,loadplanners,Operation mangagers etc. can make you do anything illegal or unsafe. if you felt the conditions were unsafe to drive in you should have found a safe place and parked the truck. Since you did not do this you have lost your license and your job. I doubt you have any recourse against estern Express they are going to say that you were driving the truck and should have got off the road if the conditions were unsafe. They will deny telling you to drive when you told them the conditions were unsafe.

I hope the information that I have provided will help you. Just remember that you are in charge of driving the truck and If you would have told them that you were going to stop because it was unsafe to drive and were terminated you would have legal recourse against Western Express.

Imagine that, the guy who preaches spelling and grammar [me] found guilty!

I posted before my first cup of coffe, so I claim not responsible!

Anyway, as an OTR Class A driver with over 2 million safe miles logged, heed this advice:

NEVER let ANYONE "force" you to operate unsafely or illegally. Even if they try, immediately pick up the phone to the FMCSA compliance hotline.

YOU are always in charge, regardless of the geek who calls himself a dispatcher, driver manager, etc.

YOU and ONLY YOU are in charge of and responsible for the safe and legal operation of that CMV.

JUST SAY NO!

And if they fire you or retaliate in any way, you can get them huge fines and a civil lawsuit for your damages that you will win hands down if you keep documentation.

DONT LET THEM GET AWAY WITH IT!!!!

Jamie... FYI...

First, i am sorry to hear of your misfortune, and I am not putting you down in any way...

HOWEVER..I know the pressure can be great to do something you dont want to do, BUT no one can make you run illegally.

You make a choice to run illegally, for whatever reason.

under the laws that govern the CDL, and the whole purpose of the CDL was to create responsibility.

Unfortunately, it is your LEGAL responsibility to just say know, and if the CO then retaliates against you or fires you, you then have recourse.

Once you break the law, you have no recourse, and become accountable.

File complaints with the FMCSA. They can still investigate and take action against the CO especially if there is a pattern of illegal behavior and complaints.
